On 01/21/2022, Licensing Program Analyst (LPA) Tran conducted an in-person inspection to deliver the finding regarding the above complaint allegations. LPA Tran met with Evelyn Rodriguez, Assistant Director. The Covid-19 Emergency Response questionnaires were asked. A tour around the facility was conducted, and a census was taken. Observed at the time of the visit was a total of 20 preschool children and 6 staff members. A review of staff criminal clearance records on this date indicated that all facility staff or other individuals who required caregiver background checks have received criminal record and child abuse index clearances or exemptions.

On 10/26/2021, the Department received a complaint alleging Staff did not ensure daycare child turned in assignments and Staff did not provide adequate supervision. Reporting Party (RP) stated the daycare had agreed to teach RP’s child during daycare since the child was doing school online and they agreed to ensure assignments were complete. The elementary school teacher called RP to let RP know that C1 had not turned in homework for 3 months. RP also stated the child came home with a mark on the child’s back. RP did not know when the incident occurred; did not have the photo of the mark. RP stated RP will email LPA Nguyen the contract regarding picking up and helping with homework along with the email from the elementary teacher about being late on turning in the assignment for the children’s homework. LPA has never received any emails or documents from RP.

During the staff interview, S1 disclosed that picking up and helping the children with homework are extra services the facility offers to the parents without additional cost and are not listed in the contract. S1 stated it must be C1’s mother that filed the complaint against the facility because the mother did not pay the tuition for about 3 weeks in October 2021. All interviewed staff stated S1 helps the children with their homework.
All interviewed staff denied witnessing any child being stomped by other children and no child complaint to staff members that any child being stomped on any child. Staff members stated they provided supervision to children at all times.

LPA Nguyen reviewed the children’s files and there’s no agreement from facility to pick up or helping the children with homework.

LPA Nguyen attempted to interview subject children three different times, but they were not available for interviews. LPA Nguyen interviewed two additional children who indicated that they did not know about any children turning in homework late at school; interviewed children shared that they like the facility and never witness any friends that stomp over or hurt other friends.
LPA Nguyen contacted four parents by phone and was able to interview one parent. Interviewed parent stated they like the facility, all staff members are very nice, and they did not have any concern or issue with the facility.

Based on the information gathered from LPAs' interviews and reviewing records, there is insufficient evidence to corroborate the allegations. Although the allegations may have happened or are valid, there is not a preponderance of evidence to prove Staff did not ensure daycare child turned in assignments as was agreed to in the contract and Staff did not provide adequate supervision did or did not occur, therefore the allegations are UNSUBSTANTIATED.

Exit interview was conducted. The Notice of Site Visit was posted. Facility representative was informed that the Notice of Site Visit must be posted for 30 consecutive days. Failure to post will result in civil penalty of $100. “The licensee was provided a copy of their appeal rights (LIC 9058 12/15) and their signature on this form acknowledges receipt of these rights.” This report LIC 9099 was provided to the director. First level appeal is to Regional Manager, address is above on the report.
