On 07/21/2023, Licensing Program Analyst (LPA) Romy Castanon made an unannounced visit to the facility to deliver findings of a complaint that was received at the Orange County Regional Child Care Program Office. LPA met with Director Evelyn Rodriguez and explained the reason for today’s visit. Observed at the time of the visit was a total of 7 children and 2 staff members.

A review of the Facility Personnel Report Summary on 07/21/2023 indicates all facility staff or other individuals who require caregiver background checks have received criminal record and child abuse index clearances or exemptions.

On 05/18/2023, the Regional Office received a complaint report alleging staff did not prevent daycare child from engaging in inappropriate behavior. Reporting Party (RP) states that Child #1 (C1) is being bullied by Child #2 (C2). (Continue to Page 2)

RP states C1 has mentioned incidents at school of C2 hitting, biting, slapping, kicking, and pushing them. RP stated they had not mentioned any incidents to the Director until recently because they observed teeth marks on C1’s left arm. LPA attempted to contact RP on 05/22/2023 for interview but they were not available.

LPA conducted their initial visit on 05/22/2023 and interviewed Director and 2 staff members. LPA interviewed 2 staff members on 05/31/2023 and interviewed 6 children on 07/18/2023.

5 out of 5 staff members were able to provide LPA with examples of procedures when dealing with difficult behaviors such as redirection or notifying the Director. 3 out of 5 staff stated they have communicated challenging behaviors to the Director or parents. 2 out of 5 staff stated they keep C1 and C2 separate to avoid incidents.

LPA reviewed facility “Ouch Reports” for the past six months. LPA obtained a copy of a report dated 05/01/2023 regarding a child biting C1 on the right arm that was signed by C1’s parent.

LPA interviewed 3 out of 5 parents. There were no disclosures made during the parent interviews. During children’s interviews, 1 out of 6 children stated staff will step in to stop a conflict between children.

Based on LPA’s interviews conducted, the allegation staff did not prevent daycare child from engaging in inappropriate behavior may have happened or is valid, there is not a preponderance of evidence to prove the alleged violations did or did not occur, therefore the allegation is unsubstantiated.

Exit interview conducted and report was reviewed with Director Evelyn Rodriguez. Director was provided a copy of their appeal rights (LIC 9058) and their signature on this form acknowledges receipt of these rights. A notice of site visit was given and must remain posted for 30 days.
