On 03/21/2024 LPAs Trinh and LPA Nguyen interviewed the Preschool Director, and Assistant Director member, obtained and reviewed the children’s roster, staff’s records including timecards, and school policy regarding background checks.
During an interview on 03/21/2023 with staff Mauritania Alvarez, Alvarez stated that the facility requested that she get fingerprinted. Alvarez stated she completed the process on 09/09/2023 and started working on 09/07/2023. Alvarez stated that she was not aware that S1 did not have a criminal clearance. Alvarez confirmed that she worked at the facility for a few months.
LPA interviewed the director and 1 staff that were able to confirm that Alvarez was working with children in a classroom at the facility, in addition to staff time- sheet from September, October of 2023, and March 2024, Staff Welcome letter, LIC 9163, and Personnel Record. that Alvarez was working at the facility from 09/09/23 to 03/14/24 without a criminal record clearance.
Based on LPAs’ interviews with staff on 03/21/2024 and record reviews of staff’s records, the preponderance of the evidence standard has been met, therefore the above allegation about unclear staff caring and supervising day-care children is found to be substantiated. The following violation is being cited in accordance with California Code of Regulations, Title 22, Division 12, 101170(e)(1) Criminal Record Clearance. An immediate civil penalty was assessed today.
LPA V. Trinh informed the Assistant Director Sonia Rhee that this report dated 3/18/2024 documents 1 Type A citation which shall be posted for 30 consecutive days as there is/are immediate risk(s) to the health, safety, or personal rights of children in care. Also, LPA V. Trinh informed the Assistant Director, Sonia Rhee, to provide a copy of this licensing report dated 4/23/2024 that documents any Type A citation to parents/guardians of all children currently enrolled by the next business day or the next day the children are in care, and to any newly enrolled parents/guardians for 12 months from the date of this report. A signed Acknowledgement of Receipt of Licensing Report (LIC 9224), or other written statement, must be placed in the child's file for verification.
