On 10/10/2024, Licensing Program Analyst (LPA), Anna Chan, conducted a follow up investigation to deliver findings regarding the above complaint allegation which was initiated on 09/04/24. LPA met with director, Taryn Stephens and was led on a tour of the facility. There are no children present when LPA arrived. Children will start coming in around 2:45pm from school.

The Orange County Regional Office received a complaint on 08/26/24 alleging unexplained injury.

LPA interviewed school-age children. Child 2 (C2) stated that Child 5 (C5) is mean. Child 0 (C0) stated C5 told C0 to scratch their face on the wall and was threatening C0. C0 stated they scratched their face on the wall and obtained a scrape on their right cheek. Child 3 (C3) stated that C3 heard C5 telling C0 to scratch C0’s face on the wall but did not see C0 do it. C0 stated C5 bosses the other children around in the class.

LPA observed C0’s face with a round scratch mark on right cheek.

LPA interviewed staff; staff stated they did not witness the incident with C0 causing a scrape on the face.

On 10/4/2024,LPA interviewed two (2) parents, none of whom disclosed any information that could support the allegation.

Based on LPAs observation and conducted interviews, the preponderance of evidence standard has been met, therefore the above allegation is found to be SUBSTANTIATED. A substantiated finding means that the complaint is substantiated, and the allegation is valid because the preponderance of the evidence standard has been met. See LIC9099D for a Type B deficiency cited. Civil Penalty Assessed for repeat violation

An exit interview was conducted with Director Taryn Stephens. The Notice of Site Visit was posted during the visit. The director was informed that the Notice of Site Visit must be posted for 30 consecutive days. Failure to post will result in civil penalties of $100. The director was provided a copy of their appeal rights (LIC 9058 01/16) and their signature on this form acknowledges receipt of these rights. First-level appeals should be sent to the regional manager to the address listed above.

Director stated the facility will work with the children about personal rights and the facility will be looking in to working with Start well or other options on how teachers can handle children and be more vigilant supervising. Facility will send the documented plan to LPA by 11/11/24.

On 10/4/2024, LPA interviewed two (2) parents, none of whom disclosed any information that could support the allegation.

Based on the interviews conducted and records reviewed, the preponderance of evidence standard has not been met. Although the allegation may have happened or are valid, there is not a preponderance of evidence to prove the alleged violation did or did not occur, therefore the allegation is UNSUBSTANTIATED.

Exit interview was conducted with Director Taryn Stephens. Notice of Site Visit was posted during the visit.
