The complaint received on 05/17/2021 alleged that a Staff member (S1) hit a day care child (C1). Prior to the 10 Day Initial Visit LPA Corral interviewed C1’s Mother. During the initial 10 Day Tele-Inspection LPA Corral interviewed Administrator Ira Vithanage and the staff who allegedly hit the child (S1). During the interview with C1’s mother on 05/21/2021, mother stated her child told her that S1 hit him in the face. Child also told his mom he was hit by another friend C2. C1’s mother stated she contacted the Administrator Ira to inquire about the incident. C1’s mother visited the Facility on 05/14/2021 and spoke with Ira, the alleged teacher S1 and an additional teacher (S2). C1’s Mother stated she asked her child what happened. Her child then pointed to the alleged teacher S1 and said, “she hit me on my face”. Mother stated Ira and teacher denied allegation and said the incident did not happen.
During the Initial 10 Day Tele-Inspection, LPA Corral conducted an interview with Administrator Ira. Ira stated she does not have a problem with S1 and S1 has been employed with the Facility for 2 years. Ira also questioned S2 about the incident and S2 stated she has not seen S1 hit a child during her time of employment. When LPA Corral questioned Alleged Staff Member (S1) regarding the allegation, S1 stated she would not hit a child.
Administrator Ira informed LPA Corral that C1’s mother visited the Facility on Monday 05/17/2021 to speak to her and S1. Ira stated child is happy and comfortable in the Facility. LPA Corral also contacted C1’s mother on 06/21/2021, Mother confirmed that C1 is back in care and has not had issues with the facility. Based on the interviews that LPA Corral conducted there is insufficient evidence to corroborate that a Staff Member hit a day care child. Although the allegations may have happened or are valid, there is not a preponderance of evidence to prove the allegations did or did not occur, therefore the allegation is Unsubstantiated.
Exit interview was conducted and report was read to Administrator Ira. A copy of the Investigation Report along with Appeal Rights were provided to the Administrator, Appeal Rights were also explained. Director was informed first level of appeal is directed to Regional Manager to the address listed above. Notice of Site Visit was posted.
