On 05/10/2022, Licensing Program Analyst (LPA) Stacy Torrence conducted an in-person inspection to deliver the findings regarding the above complaint allegations. LPA Torrence met with Crystal Lauture, Director. There was a total of seven school-age children present, with two staff supervising. A review of staff criminal clearance records on this date indicated that all facility staff or other individuals who required caregiver background checks have received criminal record and child abuse index clearances or exemptions.
On 02/22/2022, Licensing office received a complaint alleging the following: staff did not prevent inappropriate behaviors between day care children, staff did not provide day care child’s authorized representative with accurate information regarding incident, and facility wrongfully terminated day care child. Reporting Party (RP) reported a parent called and informed them that parent’s child told the parent that another child put their face on child’s private area (clothes on), parent reported a call was received by the Directors of the incident; however, parent wasn’t given any information about what happened. RP stated parent informed the Directors that a compliant will be filed, and Directors told parent they were going to disenroll the children, parent received a two-week dis-enrollment notice via email.

During the course of the investigation, LPA Torrence interviewed the Parent and it was discovered the report was signed by the parent; however, parent did not ask for a copy. Parent stated the directors did not accurately report the incident to parent. Parent stated, at the time, parent had to leave in a hurry was late for an appointment and was told by the directors that a child grabbed parent’s child in the thigh area and part of the other child’s body part touched parent’s child’s genital area. Parent stated after questioning the child further about the incident, it was told that the child placed their face on child's private area. Parent stated the director told the owner about what transpired between the children and they decided to terminate the parent's children. Parent indicated the children attended the facility for the next two weeks. Parent indicated a copy of the Admission Agreements were received from the facility; however, did not know where they were.
During the course of the investigation, LPA Torrence interviewed three staff members. Staff 1(S1) stated, while on the playground, she noticed Child 1(C1) climbing on the slide with Child 2 (C2) and witnessed C1 attempting to grab C2’s arm and shove C2. S1 stated they intervened and told both children to keep their hands to themselves. S1 reported C1 told her C2 put C2’s head on C1’s lap and pulled C1 into C2. S1 reported C1 also went to Staff 2 (S2) and told S2 that C2 touched C1 thigh, which was a different account of what was told to S1. S1 stated there were 10 children on the playground, with two staff supervising, and while they were on the playground, they were walking around watching the children.
S2 stated C1 came up and said C2 grabbed C1’s thigh and pulled C1’s pants. S2 stated C1 did not give a more specific answer to what happened. S2 stated C1 either said C2 touched or tried to touch C1’s private area. S2 stated wasn’t sure what C1 was trying to say. S2 stated they were on the playground and did not see anything like the alleged incident happening on the playground.
S1 stated parents are notified immediately regarding any incidents that occur at the daycare, in a written report. (S2) and Staff 3 stated when there is an incident a report is written, office is notified, then the report is given to the parents by the program director.
S1 stated the facility’s termination policy is at will termination, and a 2-weeks-notice is given to parents.

During the course of the investigation, LPA Torrence interviewed five children. Interviewed children stated teachers are watching them while they play on the playground and never leave them alone. Interviewed children made no disclosure.

During the course of the investigation, LPA Torrence conducted a collateral visit to Child 1(C1) and Child 2(C2) new facility to interview them. C1 refused to talk and there was no disclosure made by C3.

During the course of the investigation, LPA Torrence obtained a copy of the parent’s signed Admission Agreements which states: “The Child Care Provider retains the right to terminate this Agreement at any time.” LPA Torrence obtained a copy of emails that were between the parent and one of the directors. After reviewing the email, LPA Torrence discovered the owner decided to give the parent a 2-weeks’ notice to dis-enroll the children from the facility. The email also provided the parent with locations of other facilities that may accommodate the parent’s needs.

During the course of the investigation, LPA Torrence obtained and reviewed a copy of the incident report dated 02/16/2022, from the facility. The incident report stated a student grabbed the child’s thigh and pants to pull child closer as child did this the child put their hand on the other child’s private area. After reviewing the report, LPA discovered the report was signed by the parent and it indicated, the parent declined to receive a copy of the report.

04/19/2022 LPA was able to interview three parents. Interviewed parents stated they had no issues or concerns, nor complaints about the day care.

Based on the information gathered from LPAs' interviews and reviewing records, there was insufficient evidence to corroborate the allegations. Although the allegations may have happened or is valid, there is not a preponderance of evidence to prove the alleged violations did or did not occur; therefore, the allegations are unsubstantiated.

Exit interview was conducted. The Notice of Site Visit was posted. Appeal Rights was explained. A copy of appeal rights (LIC 9058 1/16) will be provided through email and their signatures on this form acknowledges receipt of these rights. First level appeal is to Regional Manager, address is above on the report.
