During the investigation, 3 staff members were interviewed 02/16/21 and 02/22/21. All three staff members were aware of the incident that happened on 02/04/21. S1 stated, on 02/04/21, C1 had an accident. C1 was given extra clothes to change into. S1 stated they couldn’t remember helping child, but C1 changed own clothes outside the restroom. When asked, is that the normal routine, S1 stated, “No”, it just happened. S1 stated, S3 was preparing snacks, and I was cleaning cots away. S1 disclosed they have never received any training at the facility, but the routine if a child has an accident is, to check for extra clothes in the cubby, get a plastic bag for the dirty clothes and take the child into the restroom to change. When questioned, what is personal rights, S1 stated, “I don’t know”. When questioned, why did child change in the classroom and not in the restroom, S1 stated, “I don’t know”.
S3 stated, when they started working at the childcare on 02/2020, they were never given proper training on classroom and facility procedures. S3 stated, just following the guidance of co-teacher in the classroom. On 02/04/21, C1 had an accident during nap time, upon waking up, S3 got C1 a change of clothes and took child to the bathroom to change. S3 disclosed the bathrooms are too small to change in, therefore C1 changed outside the bathroom. S3 was unaware that C1 was in view of the camera and child could be seen naked. Before this incident, S3 was never informed children could be seen changing outside the restroom. S3 stated, S4 never trained or provided any tips to change children when they have accidents, only to make sure staff is standing with the children at the restroom door.
Based on LPA’s facility inspection, observations, interviews conducted with complainant party, director, 3 staff, pictures provided, records reviewed, and pictures taken by LPA, it has been determined that the facility did violate child’s personal rights by leaving child inside the classroom outside the restroom against the wall to change clothes in which video camera captured child exposed and naked in front of all the classmates. Therefore, the preponderance of evidence standard has been met, therefore the above allegation: Personal Rights are found to be Substantiated. California Code of Regulations, Title 22, 101223(a)(3) Personal Rights is being cited on the attached LIC 9099D.
