32 | The five children interviewed stated, while on the playground playing, the teachers are watching them. No disclosures were made by children, all five children denied touching another child in their private parts or seeing other children touching each other in their private parts. LPA Torrence interviewed six staff members. No disclosures were made by staff, all six staff members denied witnessing any inappropriate behavior between the children in care and denied any children telling them they have been touched in their private parts.
Allegation: facility staff failed to protect child from being bullied by other children. On 02/11/2020, complainant reported her child told her several times she was being bullied (verbally and physically) by children in the daycare. On 02/18/2020, LPA interviewed Child #1 at home. Child #1 stated kids were being mean to her; however, could not disclose to LPA how they were being mean to her or who was being mean to her. On the same day, LPA interviewed five children at the daycare facility. No disclosures were made by children, all five children denied seeing other children hitting or being mean to one another. All five children also denied being mean or hitting other children. All six staff reported they have not witnessed children bullying or teasing each other. Staff #6 reported the children are too little, they do not know how to bully. All staff reported no parents complained to them about their child being bullied.
Parents that were interviewed stated they liked the daycare, the director, and the teachers. Parents reported they had no concerns or issues with the facility.
Based on the information gathered from LPA's interviews, there is insufficient evidence to corroborate the allegations. Although the allegations may have happened or are valid, there is not a preponderance of evidence to prove the alleged violations did or did not occur, therefore the allegations are unsubstantiated.
Exit interview was conducted. The report was reviewed and discussed. The facility representative was informed that the “Notice of Site Visit” must be posted for 30 consecutive days. Failure to post will result in Civil Penalties of $100.00. The “Notice of Site Visit” must be posted on or adjacent to the door. |
