A case management inspection was conducted at this facility by Licensing Program Analyst (LPA) Port and LPA Nelson due to self-reported incident dated 06/12/19. This is a continuation of the investigation initiated on 06/21/2019.

Upon arrival LPAs met with director who was observed caring for 5 preschool age children. There were an additional 4 preschool age children with another staff member. During today's inspection it was determined that the facility was operating within compliance of staffing ratios and within its licensed capacity. A review of staff records indicates all facility staff or individuals who require caregiver background checks have received a criminal record clearance or exemption and a child abuse index clearance.

LPAs met with director and discussed the unusual incident report in which a child disclosed to their guardian that personal rights may have been violated by a staff member. On 06/11/2019 child disclosed to the father child was inappropriately touched by a staff member. This unusual incident was investigated by Investigator L. Charlemagne from Investigation Branch (IB). Investigator Charlemagne conducted interviews with four adults, four staff members and six children. Third party agency reports were also obtained and reviewed. In the interviews conducted staff members stated they did not witness any inappropriate behavior by the subject staff member. There were discrepancies among the disclosure made by the subject child. Additional children interviewed did not provide any information to support the disclosure. Based on the interviews conducted and the information obtained, there is not a preponderance of evidence to support the child's disclosure.

There were no deficiencies cited at this time.

Exit interview was conducted. The Notice of Site Visit was posted. Director was informed that the Notice of Site Visit must be posted for 30 consecutive days. Failure to post will result in civil penalties of $100. Appeal rights were provided and explained.
