Licensing Program Analyst (LPA) Barajas conducted a complaint investigation to deliver findings. This is a continuation of the investigation initiated on 02/04/21, 02/24/21 and 03/24/21. LPA met with Licensee Margarita Calero, who guided LPA on tour of the facility. LPA observed 5 infant children in room 2 with two Staff. During today’s inspection the facility was operating within its licensed capacity and within compliance of staffing ratios. A review of staff records on this date indicated that all facility staff or other individuals who required caregiver background checks have received criminal record and child abuse index clearances or exemptions.

During the investigation, LPA interviewed Director, 5 of 6 Staff members on 02/04/21, 02/26/21, and 03/24/21. No children were interviewed due to age and being nonverbal, reviewed sign in sign out sheets, reviewed personnel files, obtained copy of the Children’s Roster (LIC 9040), Facility Sketch, conducted three separate inspections of facility.

An allegation: Staff failed to provide a safe and comfortable environment.
Complainant Party (C/P) reported to licensing Dept that infant room has sockets and plugs which are not covered and the children can easily put their fingers inside sockets.

The Director was interviewed on 02/21/2021 at the facility. Director disclosed facility is operating good, infant classroom only has 5 infants registered and sometimes only 4 children show up. Director stated facility provides a safe and comfortable environment for children always. Facility is clean and provides a healthy and safe environment especially right now during COVID. Director stated they are more careful now and take temperatures of children and parents at drop off, clean and sanitize toys constantly.
During the investigation, LPA interviewed 5 staff on 02/04/21, 02/26/21 and 03/24/21 Staff disclosed maintain classroom safe and comfortable for infant children. Staff disclosed always sanitizing areas, and toys and items children use. All staff disclosed always wipe down mats and tables, and make sure items are stored and locked if needed.
During the investigation LPA conducted 7 of 8 parent interviews via telephone. All parents disclosed like facility and have no concerns.

LPA’s Barajas and Odom conducted facility visit on 02/04/21 and facility was clean, safe and comfortable. LPA Barajas on 02/26/21 conducted a solo visit and found infant room to be clean, safe and comfortable for children in care. Sockets and plugs were up to licensing standards, cabinets were locked, and cleaning supplies was stored and locked under sink. On 03/24/21 LPA conducted a third visit via facetime and infant classroom was clean, safe and provided a comfortable environment for children in care and inspected light plugs and sockets all were covered in infant room.

Based on LPA Barajas two in person infant classroom observation, tele inspection, information and interviews gathered by from C/P , Director, 5 staff and 7 parents, records reviewed and the inability to interview children as they did not qualify there was insufficient evidence to determine if the allegation: Staff failed to provide a safe and comfortable environment is substantiated. Facility is safe and comfortable for children in care. Although the allegation: Staff failed to provide a safe and comfortable environment, may have happened or is valid, there is not a preponderance of evidence to prove the alleged violation did or did not occur, therefore the allegation is UNSUBSTANTIATED.

The complainant alleged Facility is dirty.
Complainant Party (C/P) reported to licensing Dept that infant room is dirty, cluttered, floors are not mopped, room is not sanitized, they don’t sanitize toys after every use or changing tables and changing paper is on the floor. C/P stated facility uses cribs as storage.

The Director was interviewed on 02/21/2021 at the facility. Director disclosed facility is operating good, infant classroom only has 5 infants registered and sometimes only 4 children show up. Director stated facility provides a clean safe and comfortable environment for children always. Facility is clean and provides a healthy and safe environment especially right now during COVID. Director stated clean and sanitize toys constantly. Facility is constantly sanitizing areas commonly use with disinfectant. Facility is mopped every day and as needed. Facility maintains extra cleaning supplies in adult staff restroom locked if needed.

During the investigation, LPA interviewed 5 staff on 02/04/21, 02/26/21 and 03/24/21. Staff disclosed maintain classroom clean safe and comfortable for infant children. Staff disclosed always sanitizing areas, and toys and items children use. Staff disclosed always wipe down mats and tables. All staff disclosed due to COVID facility is even cleaner, always cleaning and sanitizing.

During the investigation LPA conducted 7 of 8 parent interviews via telephone. 3 of 7 parents disclose facility is clean. 4 of 7 parents disclosed not sure as not allowed to go inside facility, however a parent disclosed child comes home clean. Two other parents disclosed facility looks clean, can’t complain.
LPA Barajas and Odom conducted facility visit on 02/04/21 and facility was clean, safe and comfortable.
LPA Barajas on 02/26/21 conducted a solo visit and found infant room to be clean, safe and comfortable for children in care. LPA’s observe hand sanitizer in classroom and cleaning supplies locked under classroom sink. LPA’s observed staff do not wear shoes in infant room and changing tables were clean.
Based on LPA Barajas two in person and 1 tele visit infant classroom observation, information and interviews gathered by from C/P , Director, 5 staff and 7 parents, records reviewed and the inability to interview children as they did not qualify there was insufficient evidence to determine if the allegation: Facility is dirty is substantiated. LPA observed the facility to be clean for the children in care in 3 separate visits. Although the allegation: Facility is dirty, may have happened or is valid, there is not a preponderance of evidence to prove the alleged violation did or did not occur, therefore the allegation is UNSUBSTANTIATED.

The complainant alleged play structures are not age appropriate
Complainant Party (C/P) reported to licensing Dept that infant play structures are not age appropriate. C/P stated play structures are not properly secured to wall.

The Director was interviewed on 02/21/2021 at the facility. Director provided LPA’s on a physical facility tour of the playground located on side of day care. Director disclosed has very few infants and due to weather, they are hardly outside. Director disclosed playground structures are age appropriate and are sanitized daily especially during COVID.

During the investigation LPA conducted 7 of 8 parent interviews via telephone. Parents had no concerns with playground structures or facility.

LPA Barajas and Odom conducted facility visit on 02/04/21 and LPA conducted a solo visit on 02/26/21 and tele visit on 03/24/21. LPA’s toured the outside left infant playground structure and playground was age appropriate and safe for the children in care. LPA checked fence and door locks. Locks and fence were working. LPA requested Pictures of outdoor play structure.

Based on LPA Barajas two in person infant classroom observation, and tele visit , information and interviews gathered from C/P , Director, 5 staff and 7 parents, records reviewed and the inability to interview children as they did not qualify there was insufficient evidence to determine if the allegation: Play structure are not age appropriate for the children in care. Although the allegation: may have happened or is valid, there is not a preponderance of evidence to prove the alleged violation did or did not occur, LPA’s visually inspected and observed equipment to be safe and age appropriate therefore the allegation is UNSUBSTANTIATED.

The complainant alleged Infants milk bottles are not being labeled
Complainant Party (C/P) reported to licensing department allegation: infant milk bottles are not being labeled. C/P disclosed milk bottles are just being placed in cubbies, not dated and no one can tell which is formula or breast milk. C/P stated staff usually leave breast milk out for 2 hours to defrost. Cook prepares formulas for children.

The Director was interviewed on 02/21/2021 at the facility and stated teachers label bottles and food. Director stated facility has a label maker and staff add child’s name and dates.

During the investigation, LPA interviewed 5 staff on 02/04/21, 02/26/21 and 03/24/21. All 5 staff disclosed infant teachers label child name and date on milk bottles with label maker provided by facility. Staff disclosed some parents label child’s bottles, snacks and food. Staff disclosed infant teachers prepare bottles and sometimes facility cook will help prepare bottles when infant room is in ratio. All staff disclosed children are fed when hungry, have a meal plan, or during assigned breakfast, lunch or snack times and any left-over food brought from home is returned to parents at end of the day.
During the investigation LPA conducted 7 of 8 parent interviews via telephone. All 7 parents disclosed they label bottles at home but if they forget facility staff labels and dates milk bottles. Parents had no concerns with milk bottles being labeled or food procedures.

LPA Barajas and Odom conducted facility visit on 02/04/21, LPA Barajas on 02/26/21 conducted a solo visit and in both occasions visually inspected infant milk bottles. All bottles were labeled with child name and date in child’s cubbies. LPA’s also inspected kitchen cabinet and refrigerator and found milk bottles, formula, breast milk and baby food and all was labeled with child’s name and date. LPA’s did not visually observe any bottles without labels.

Based on LPA Barajas infant classroom visual observation on two different dates 02/04/21 and 02/26/21, interviews gathered from C/P , Director, 5 staff and 7 parents, records reviewed and the inability to interview children as they did not qualify there was insufficient evidence to determine if the allegation: Infant milk bottles are not being labeled is substantiated. Although the allegation: Infant milk bottles are not being labeled, may have happened or is valid, there is not a preponderance of evidence to prove the alleged violation did or did not occur, therefore the allegation is UNSUBSTANTIATED.

The complainant alleged Staff Falsifies documentation
Complainant Party (C/P) reported to licensing Dept that staff falsifies documentation. C/P stated staff falsify by documenting they are changing diapers more often than they are. C/P stated a staff became upset for changing a diaper and child was not fully wet. C/P stated diapers are changed every two hours.

The Director was interviewed on 02/21/2021 at the facility. Director stated facility has their own infant Daily Report which she provides to parents daily at pick up time. Director disclosed staff who work in classroom or herself will fill out Infant daily report. Director denied staff falsify documents in relation to diaper changes, feeding and sleeping times. Director disclosed parents have not complained or brought to her attention any concerns with excessive diaper use or changes or anything related to infant children and classroom.

During the investigation, LPA interviewed 5 staff on 02/04/21, 02/26/21 and 03/24/21. All Staff disclosed facility has own infant day care log for each child and a staff fills out or Director. All staff disclosed parents are provided form at pick up time and explains to parents feeding, sleeping and diaper change times along with behavior. Staff disclosed change diapers as needed and have never received complaints or concerns from parents regarding diaper changes, food and sleeping schedules.

During the investigation LPA conducted 7 of 8 parent interviews via telephone. Parents disclosed communication is good in person, via application JoJo and in writing. A parent disclosed receives updates via APP daily. A parent disclosed messages staff through application and staff respond very quickly. One parent disclosed not much communication. A parent disclosed facility provides the necessary communication if a child gets hurt, parents are notified immediately. A parent provided LPA with a copy of Infant Daily Report provided daily. No parents had issues or concerns with falsification of documentation regarding infant children sleeping , feeding and diaper schedules changes and or communication.

LPA Barajas and Odom conducted facility visit on 02/04/21 and LPA Barajas conducted a separate solo visit on 02/26/21 and 03/24/21 and LPA reviewed facility own Infant Daily Report. Director provided LPA a blank form to attach to file. LPA Barajas reviewed and discovered each child present at day care had a form being filled out. LPA’s also conducted records reviewed and observed in all children’s file (LIC 702) Child's Preadmission Health History-Parent Authorized Representative Reports.

Facility had no parent complaints or concerns with documentation and parents are provided everyday an Infant Daily Report created by facility. Although the allegation: Staff falsifies documentation, may have happened or is valid, there is not a preponderance of evidence to prove the alleged violation did or did not occur, therefore the allegation is UNSUBSTANTIATED.

Facility is operating out of ratio
Complainant Party (C/P) reported to licensing Dept facility is operating out of ratio. C/P stated infant room is operating out of ratio as one teacher is caring for 5 infants by herself. C/P stated on 02/01/21 and 02/02/21 observed only one staff with 5 infants in classroom. C/P stated facility currently cared for 6 children, but a child had not showed up for two weeks. C/P stated staff walk out of infant room all the time and leave other staff out of ratio. C/P was left alone 6 times between 02/01/21 and 02/02/21 while staff go grab infant milk bottles.

The Director was interviewed on 02/21/2021 at the facility. Director stated facility has not been out of ratio in infant room. Director stated does not have many children enrolled in infant license. Director stated first staff arrives at 6:30a.m. and second staff arrives at 7:30a.m.. Director stated children are never left alone and staff need a bottle to be prepared they ask cook for help or ask for assistance. If help is needed in infant room, she has extra staff and she also helps to maintain license in ratio. Director emailed LPA copies of sign in sign out sheets, and timecards of infant staff.

During the investigation, LPA interviewed 5 staff on 02/04/21, 02/26/21 and 03/24/21. All Staff disclosed facility has not been out of ratio, infants have low enrollment. All staff disclosed do not leave children alone and if they need help, they ask Director or cook for assistance with milk bottle preparation. Staff disclosed usually two teachers in infant room.

Parents disclosed don’t know if facility is out of ratio and have no way of knowing as not allowed to go inside classroom due to COVID. All parents disclosed have never seen 1 staff with more than 4 infants in infant room by themselves.

LPA Barajas and Odom conducted facility visit on 02/04/21 and LPA Barajas conducted a separate solo visit on 02/26/21 and 03/24/21 and infant room was in ratio. LPA reviewed sign in sign out sheets for 5 children beginning 01/29/21 through 02/02/21 and 5 staff time sheets and infant license was always in ratio and had enough staff to cover infant room.
Based on LPA Barajas two in person infant classroom observation, interviews gathered from C/P , Director, 5 staff and 7 parents, records reviewed and the inability to interview children as they did not qualify there was insufficient evidence to determine if the allegation: Facility is operating out of ratio is substantiated. Facility always had 2 staff working with 5 children and extra staff was available if needed. Although the allegation: Facility is operating out of ratio, may have happened or is valid, there is not a preponderance of evidence to prove the alleged violation did or did not occur, therefore the allegation is UNSUBSTANTIATED.

Staff commingles different age groups
Complainant Party (C/P) reported to licensing Dept that staff commingles different age groups. During interview with RP LPA explained facility has toddler option waiver for 7 children in room 6. LPA explained to RP there are children from 18 months through 24 months in room. RP disclosed was not aware of toddler waiver.

The Director was interviewed on 02/21/2021 at the facility. Director stated they do not commingle children. Infant room only cares for infant children and toddler room has their own room and teacher. Director disclosed facility has toddler option for 7 children in room 6. LPA obtained names of children and reviewed records provided by Director.

During the investigation, LPA interviewed 5 staff on 02/04/21, 02/26/21 and 03/24/21. All Staff disclosed infant room staff only work in infant room and toddler room has their own staff. If staff need help, there is a floater teacher that helps in the classroom.

During the investigation LPA conducted 7 of 8 parent interviews via telephone. Parents did not disclose children are commingled in infant and toddler room. Parents disclosed not allowed to go inside facility therefore don’t know who cares for their children.

LPA Barajas and Odom conducted facility visit on 02/04/21 and LPA Barajas conducted a separate solo visit on 02/26/21 and 03/24/21 and LPA’s conducted a facility inspection of all-day care classrooms and children were not observed commingling with other age groups. LPA conducted 3 visits in infant room and only observed infant children. LPA also conducted a facility room inspection in toddler room and all children were in appropriate age group class and staff collaborated information.

Based on LPA Barajas two in person infant classroom observation, interviews gathered from C/P , Director, 5 staff and 7 parents, records reviewed and the inability to interview children as they did not qualify there was insufficient evidence to determine if the allegation: Staff commingles different age group is substantiated. Although the allegation: Staff commingles different age group, may have happened or is valid, there is not a preponderance of evidence to prove the alleged violation did or did not occur, therefore the allegation is UNSUBSTANTIATED.
Staff leave day care children unattended
Complainant Party (C/P) reported to licensing Dept that staff walk out of the classroom and leave children by themselves. C/P stated was left alone 6 times between Monday and Tuesday while another staff went out of classroom to grab a milk bottle. Staff disclosed staff always walk out of classroom to get stuff in kitchen.
The Director was interviewed on 02/21/2021 at the facility. Director stated they never leave children unattended, staff or herself are always in classroom. Director stated has a staff floater to give staff breaks, and if needed other staff can help too. Director stated kitchen staff helps prepare bottles and food.

During the investigation, LPA interviewed 5 staff on 02/04/21, 02/26/21 and 03/24/21. All Staff disclosed infant room staff only work in infant room if staff need help, there is a floater teacher that helps in the classroom. All staff stated children are never left unattended, if help is needed, they ask Director for help.
During the investigation LPA conducted 7 of 8 parent interviews via telephone. Parents did not disclose children are left unattended, they all stated usually Staff #2 and Staff#3 are in the classroom. Parents stated due to COVID not allowed to go inside facility.

LPA conducted 3 visits and has observed kitchen staff helping prepare food and assisting infant room with bottles or anything needed.

Exit interview was conducted with Director Margarita Calero via Tele-Inspection. Report was read to Director. A copy of the report along with Appeal Rights will be emailed to Director with a Read Receipt to acknowledge report was received. If Read Receipt is not functional, Director will respond to email stating “I have read and received the report, I acknowledge receipt.” LIC 9099 will also be mailed if those options are not available.
