On 06/29/2022 Licensing Program Analyst, Stella Gutierrez made an unannounced visit to the facility for the purpose to deliver findings of complaint that was received at the Orange County Regional Child Care Program Office. LPA was met by Annalecia Wittwer, Administrative Assistant who explained the reason for today’s visit. During today’s inspection

A complaint was received on 05/09 /2022 alleging that there are 2 unqualified staff providing supervision and care to classrooms independently. The complainant stated that there is concern for the children’s safety when the alleged unqualified staff are providing care alone to the children at the facility.
On 05/16/2022 LPA’s, Stella Gutierrez and Patricia Duran made an unannounced inspection to the facility regarding the allegation of Qualifications- Unqualified staff providing care to children. LPA’s reviewed records for Staff #1 and Staff #2, Interviewed the director and both staff members.
It was revealed that Staff #1 and Staff#2 provide care in the classrooms without the supervision of a fully qualified teacher. Page 1 of 2

Records reviewed for Staff #1 and Staff #2 coincides with the 2 staff members statements that they are not fully qualified to provide care independently at the facility and lack the ECE qualifications in accordance to tittle 22 regulation code 101216.1 (c) (1) (Teacher Qualifications and Duties) It was also revealed in statements of the interviews conducted on 05/16/2022 that the two unqualified staff members are providing care independently in the 2 year old classroom and the 3 year old classroom on a weekly basis or when as needed for the Since July of 2021. The facility director stated that the facility submitted an exception request for Staff #1 in 2021, but never received approval. Director understands the allegation and stated that it did occur and provided a written declaration of the verbal statement.

Based on interviews and records reviewed the allegation referenced on this report is substantiated. A substantiated finding means that the complaint is substantiated, and the allegation is valid because the preponderance of the evidence standard has been met. The following violation was revealed and is being cited in accordance with California Code of Regulations, Title 22, Division 12, Chapter 1, article 6, Section 101216.1 (c) (1), please refer to attached 9099 (D).

An exit interview was conducted with Administrative Assistant, Annalecia Wittwer. This report was reviewed, and a copy provided. A notice of site visit was provided and must be posted for 30 days in a prominent area.

(1) Twelve post-secondary semester or equivalent quarter units in early childhood education or child development completed, with passing grades, at an accredited or approved college or university; and at least six months of work

During the course of investigation the Director provided a written statement on form LIC 855; that she ensure to follow regulation 101216.1(a)(c) by not have S1 and S2 in the presense of children without supervision of a lead teacher. It has also been disclosed that the facility will no longer be operating effective 07/01/2022.

This requirement was not met as evidence by records review that S1 and S2 are not qualified as a lead and Director statement that S1 and S2 were caring for children without a lead teacher present. This poses and a risk to the children in care.

The last day that the facility will be open and providing care will be 06/30/2022. Type B deficiency will be cleared during today's visit.
