Tele-Inspection-COVID 19 State of Emergency
On 03/16/2021 Licensing Program Analyst (LPA) Jordann Nelson conducted an announced complaint Tele-Inspection regarding the allegation listed above with Carrie Mercado. The licensee was informed that due to COVID-19 and social distancing guidelines, the visit would be conducted via Facetime.

An allegation of there being an uncleared staff providing care, Staff failed to conduct daily inspections for illness, Lack of supervision resulting in a daycare child harming other daycare children while in care and Staff used inappropriate diapering technique.

A review of staff records, child roster LIC 500, ouch reports from June 2020 to October 2020. On this date it indicates that all facility staff or other individuals who required caregiver background checks have received criminal record and child abuse index clearances or exemptions. There were 8 children in care with 3 attending staff. Continued on page 2.

During the investigation LPA Nelson, interviewed three staff members including the, owner, director, and five parents. LPA was unable to interview any of the children, as they are all infants and toddlers with limited vocabulary skills. LPA Nelson reviewed and obtained the following: staff and children records, LIC 500 Personnel Roster along with a parent form that is given to all parents regarding health and safety protocols (wellness checks) that the school is using.

Interviews were conducted with the center’s owner, past director and current director. LPA was informed by directors and the owner that all staff prior to working at the facility, must have a criminal record clearance. LPA reviewed records for current staff, and all had complete criminal record clearance. The complaint was unable to identify the name of the person that did not have a criminal record clearance. LPA interviewed current staff, who informed LPA that they all have criminal record clearance, LPA was able to verify the information.

Interviews were conducted with five parents, director and three teachers who all stated that health and safety practices from hand washing and temperature checks were in place. Interviews with two other teachers confirmed that all inspections for illness occur, the children are sent home if their temperature is over 100 degrees. During the investigation two teachers stated that there were some children that had a runny nose, when they asked parents, parents stated that the children had allergies.

The complainant stated that there was a child that was biting other children, complainant was unable to provide name of child or further information. Interviews were conducted with five parents, four parents stated they had no concerns at all regarding any child harming their child while in care. Three teachers interviewed stated that only one child struggled with behaviors, the child was redirected. LPA reviewed ouch reports for period in question, there was no reports regarding biting.

Based on interviews conducted and conflicting information with regards to uncleared staff providing care, staff failed to conduct daily inspections for illness, Lack of supervision resulting in a daycare child harming other daycare children while in care. It is not confirmed, although the allegations may have happened or is valid, there is not a preponderance of evidence to prove the alleged violations did or did not occur, therefore the above allegations are unsubstantiated.

Exit interview was conducted with Carrie Mercado via Tele-Inspection. Report was read to Director. A copy of the report along with Appeal Rights will be emailed to Licensee with a Read Receipt to acknowledge report was received. Director was asked to respond to email by copying the following, “I have read and received the Investigation Report and Appeal Rights, I acknowledge receipt.” All appeals must be in writing and received by the Licensing office within 15 business days.
