32 | Today LPA discussed the allegations with the director, Ms. Braun and co-director, Ms. Munson. They both denied the allegation. They stated they were never out of ratio and they had enough staff to cover the number of children. Ms. Munson stated she is checking all the classrooms to make sure they are in ratio. She is available to help if any classroom is out of ratio. LPA interviewed the staff mentioned on the report. (Staff # 1). Staff # 1 stated maximum number of children in her class has been 17 children with her and either staff # 2 or staff # 4. She said she had never been left alone with more than 12 preschool children. LPA also interviewed staff # 2 and 4 which denied the allegation. They stated children are normally in their own classrooms except for occasions such as playground and special activities which they get combined. The staff have their own group of children when they are combined. LPA also interviewed the other staff from other classrooms. They also denied being left alone with more than 12 children.
LPA reviewed the days mentioned on the report (Tuesdays and Wednesdays around 9:00 am). LPA reviewed the sing in/out sheets for the children for Tuesdays and Wednesdays of 12/21/21, 12/22/21, 12/28/21, 12/29/21, 1/4/2022, and 1/5/22. LPA also reviewed the time cards of staff for those mentioned days before 9:00 am. According to the reviewed documents:
On Tuesday 12/21/21 before 9:00 am there were 13 children and 3 staff present.
On Wednesday 12/22/21 before 9:00 am there were 14 children and 4 staff present.
On Tuesday 12/28/21 before 9:00 am there were 12 children and 2 staff present.
On Wednesday 12/29/21 before 9:00 am there were 9 children and 2 staff present.
On Tuesday 1/4/22 before 9:00 am there were 24 children and 3 staff present.
On Wednesday 1/5/22 before 9:00 am there were 51 children and 4 staff present.
According to director, and co-director they were also present for the above dates, however there were no documents to show the hours for the director and co-director.
Based on the interviews conducted with the total of 9 staff, obtaining documents of staffs' time cards, children's sign in/out sheets, there is not enough proof or evidence to support the allegation due to not having the exact hours for director and co-director. This agency has investigated the complaint alleging "Day care is out of ratio"; although the allegation may have happened or is valid, there is not a preponderance of evidence to prove, the alleged violation did or did not occur, therefore the allegation is unsubstantiated. Notice of Site Visit was posted. The notice of site visit must be posted for 30 consecutive days. Failure to post will result in civil penalties of $100. The licensee was provided a copy of their appeal right (LIC 9058 1/16) and their signature on this form acknowledges receipt of these rights. Exit interview was conducted.
In the area which was investigated, no deficiency was cited today.
