Tele-Investigation COVID-19 State of Emergency

On 04/19/2021 Licensing Program Analyst (LPA) Corral spoke to Marikit Del Rosario, Site Supervisor and Joana Lafuente Early Learning Specialist to investigate an Unusual Incident Report (UIR) which was self-reported to our office on 04/13/2021. LPA notified the Site Supervisor and Early Learning Specialist that due to COVID-19 and Department of Public Health (DPH) guidelines of Social Distancing a Tele-Inspection would be conducted. The COVID-19 Emergency Response questions were reviewed and answered by Site Supervisor, Marikit. During the Tele-Inspection there were no children present in care. A review of the Facility Personnel Report Summary on 04/19/2021 indicates all facility staff or other individuals who required caregiver background checks have received criminal record and child abuse index clearances or exemptions.

According to the Self-Report incident received in our office, a Substitute Teacher was supporting a classroom and was instructed to take 2 children to the restroom, Child 1(C1) and Child 2(C2). Marikit Del Rosario (Site Supervisor) and Mariana (Teacher) observed the Substitute returning from the restroom with only C1. The UIR then stated Mariana ran across the playground to the restroom, where she found C2 crying. Mariana then brought C2 back to the classroom and comforted the child. C2 then began to play in the classroom with her friends.

The Self-Reported incident also states that Marikit, the Site Supervisor contacted Joana Lafuente, the Early Learning Specialist to inform her of the incident. The Substitute Teacher was sent home and asked to not return. Marikit informed C2’s Mother of the incident and the immediate actions that were taken. Marikit spoke to the Substitute teacher regarding the incident, and Joana reached out to the Sub-Agency. The UIR states that the Substitute teacher was identified as not being stationed at any of the Think Together Programs.

During the Tele-Inspection LPA Corral interviewed Marikit and Joana regarding the incident. Marikit informed LPA Corral that she gave the Substitute Teacher specific instructions to keep her eyes on the children and to step into the bathroom to ensure visual supervision. During the interview Marikit disclosed that the Substitute Teacher was about half-way through the yard when she and teacher Mariana observed the Substitute teacher walking back with only C1. Marikit also informed LPA Corral that C2 was left alone in the bathroom about 1-2 minutes. Marikit stated that she measured the distance from where the Substitute teacher and C1 were to where the bathroom that C2 was left in which measured about 42 meters away which is 137 feet. LPA Corral clarified that Marikit sent the Substitute teacher home and that she also informed C2’s mother of the incident. During the interview, Marikit stated that she gave the Substitute Teacher specific instructions, but they were not followed.

Marikit also informed LPA Corral that she interviewed both C1 and C2. C2 informed Marikit that she had to wash her hands and when she came out nobody was there, C2 told Marikit she was left in the bathroom. Marikit stated that Mariana the Teacher was running towards the bathroom a few seconds behind the Substitute Teacher and C1, Mariana was slightly behind the Substitute and C1. LPA Corral clarified with Joana that the door to the restroom is always open and the main entrance to that restroom did not close. Joana stated the door to the bathroom remains open because there is a hallway to the girls and the boys restroom and there is also a connecting classroom to that hallway.

After the incident, Marikit interviewed the Substitute Teacher, her first answer was, “When we left I taught she was following me.” The Substitute’s second response was “the other child walked away, and I followed that child, I didn’t realize she wasn’t following.” Joana the Early Learning Specialist did not speak to the Substitute Teacher, but she called the agency, the agency stated they would also interview the Substitute Teacher and block her from the site for future requests.

Due to the information that was obtained during the Incident Interviews with Marikit, the Site Supervisor and Joana Lafuente, the Early Learning Specialist, the facility is in Violation of California Code of Regulations, Title 22, Section 101229 Responsibility for Providing Care and Supervision.

(a) The licensee shall provide care and supervision as necessary to meet the children's needs. (1) No child shall be left without the supervision of a teacher at any time, except as specified in Sections 101216.2(e)(1) and 101230(c)(1). Supervision shall include visual observation.Regulation is being cited on the attached LIC 9099D deficiencies page, an immediate $500 Civil Penalty is also being issued on today’s date.

This report cites a Type A violation and shall be provided to Parents/Guardians of children currently enrolled and also Parents/Guardians of children newly enrolled in the facility for the next 12 months. Parents/Guardians must sign LIC Form 9224 and maintain it in each Child's file.

Exit Interview was conducted, and report was read to Joana Lafuente Early Learning Specialist and Marikit Del Rosario, Site Supervisor via Tele-Inspection. Appeal Rights were explained, Joana was informed first level appeal is to Regional Manager. A copy of Report and Appeal Rights will be emailed to Joana with a Read Receipt in lieu of a signature. Joana was asked to respond to email by stating “I have read and received Report and Appeal Rights, I acknowledge receipt." The Notice of Site Visit was not posted due to Tele-Investigation COVID-19 State of Emergency.

Based on interview with Master Teacher facility failed to supervise Child1, teacher disclosed that Child1 was left alone in the bathroom for 1-2 minutes without adult visual supervision. This poses an immediate safety risk for the children in care.
