32 | During the staff interview, all staff members denied witnessing any staff member restrained any child during nap time. Director disclosed a parent accused S2 was holding a child down during naptime. Director discussed the parent’s concern with S2 and S2 stated on 10/24/2022 SC did not want to nap and started to kick. S2 had the hands up to block the SC from kicking into S2’s face. S2 then rubbed SC’s tummy so SC can fall asleep. Staff 2 (S2) stated the following: on 10/24/2022, during naptime around 12:45am, SC was asking for a book. S2 did not have a book, so SC started to kick and tried to get out of bed. S2 held the hands up to block S2’s face from being kicked. This incident happened for about 10 minutes and SC fell asleep after S2 rubbed SC’s tummy. S2 denied restraining any child during naptime. S5 stated on 10/24/2022 at around 1:30pm, S5 witnessing S2 was rubbing SC’s back and SC was knocked out asleep. S5 also disclosed SC only wanted S2 and S3 at naptime or SC would look for them. S6 stated witnessing S2 was patting SC’s back while SC was trying to through a fit. S7 disclosed the following: On 10/24/2022, S7 was in the nap room and witnessed S2 was asking SC to stop kicking. S2 also told SC that S2 would have to put the hands over SC’s feet to block SC from hitting S2. At no time, S7 witnessed S2 was holding SC down with S2 hands.
There was no disclosure made by the four qualified children and the Subject Child.
Four interviewed parents had no issues or concerns.
Based on the information gathered from LPA’s interview, there is insufficient information to corroborate the allegation of Staff restrained a daycare child to nap. Although the allegation may have happened or is valid, there is not a preponderance of evidence to prove the alleged violation did or did not occur; therefore, the allegation is unsubstantiated.
Exit interview was conducted. The Notice of Site Visit was posted. Appeal Rights was explained. A copy of appeal rights (LIC 9058 1/16) will be provided through email and their signatures on this form acknowledges receipt of these rights.
