Licensing Program Analysts (LPA) Odom conducted an unannounced complaint investigation. This is a continuation of the investigation initiated on 05/03/2022. Upon arrival LPA met with Director, Paula Montenegro to deliver complaint findings. Director guided LPA on a tour of the facility. LPA took census, at 9:30am LPA observed a total of 5 infants with 2 staff in the infant room and 4 infants in the toddler room with 3 staff.

A review of staff records on this date indicated that all facility staff or other individuals who required caregiver background checks have received criminal record and child abuse index clearances or exemptions.

The Department received a complaint on 4/27/22 alleging staff handled day care children in a rough manner. Complainant Party (CP) stated they observed staff #5 (S5) drag Child #1 (C1) from the arms across the floor and other staff told S5 they could cause injury to C1.

During the investigation LPA Odom interviewed complaining party, director, 6 staff members, 6 parents, conducted a facility inspection and reviewed the children’s roster and personnel report. LPA did not interview children due to children being none verbal.

During the investigation, Director (S1) was interviewed on 5/3/22. S1 disclosed they observed S5 grab the infant by the hands and pulling them up to move the infant across the room. S1 stated they immediately verbally correct S5 by telling S5 they cannot grab the infant from the hands and pick up the infant in that manner. S1 disclosed S5 was never written up but they had to constantly trained and verbally correct when S5 was in the childcare center.

During the investigation, 6 staff members were interviewed on 6/8/22, 7/7/22 and 7/12/22. None of the staff disclosed observing S5 grabbing C1 and dragging them across the room or any of the other infants. Staff #2 (S2) disclosed there were a couple times S5 raised their voice to the children and S1 would have a conversation with S5 on their tone of voice. Staff #3 (S3) believed S5 was not happy at the childcare center and childcare was not their passion. S5 disclosed staff would intendedly grab children from their hands and pull them up. S5 stated the childcare center never provided infant training.

On 6/21/22 and 7/7/22 LPA Odom attempted interviewing 8 parents, however 6 parents were available for interviews. None of the parents disclosed any concern with the childcare center, they are satisfied with the childcare center. Parent #1 (P1) stated they are aware that the childcare center has discipline policies but that has never been an issue with their child.

Based on LPA’s facility inspection, observations, interviews conducted with complainant party, director, 6 staff members, 6 parents, and records reviewed, it has been determined that S5 violated children’s personal rights by handling children in a rough manner. Therefore, the preponderance of evidence standard has been met, therefore the above allegation is found to be Substantiated. California Code of Regulations, Title 22, 101223(a)(3) Personal Rights is being cited on the attached LIC 9099D.

LPA Odom informed Director that this report dated 7/14/2022 documents 1 Type A citations which shall be posted for 30 consecutive days as there are immediate risks to the health, safety, or personal rights of children in care.
Also, LPA Odom informed the Director to provide a copy of this licensing report dated 7/14/2022 that documents any Type A citations to parents/guardians of all children currently enrolled by the next business day or the next day the children are in care, and to any newly enrolled parents/guardians for 12 months from the date of this report. A signed Acknowledgement of Receipt of Licensing Report (LIC 9224), or other written statement, must be placed in the child's file for verification.

Exit interview was conducted with Director Paula Montenegro. Notice of Site Visit was posted during the visit. Director was informed that the notice of site visit must be posted for 30 consecutive days. Failure to post will result in civil penalties of $100. Director was provided a copy of their appeal rights (LIC 9058 01/16) and their signature on this form acknowledges receipt of these rights. The Department received a complaint on 4/27/22 alleging staff do not have ECE unit or experience, facility is in disrepair, and facility is out of ratio. Complaining party (CP) stated 2 aides in the toddler classroom do not have any ECE units or experience. CP stated in the month of April the bathroom in the toddler classroom had a toilet overflow. CP stated on Monday’s when Director (S1) is off 2 aides are caring for the children in the toddler room without a qualified teacher.

During the investigation LPA Odom interviewed complaining party, director, 6 staff members, 6 parents, conducted a facility inspection and reviewed the children’s roster, personnel report, staff personnel records, sign in and out sheets, and timecards. LPA did not interview children due to children being none verbal.

During the investigation, Director (S1) was interviewed on 5/3/22. S1 stated they are director qualified and fully qualified teacher. S1 stated they are currently filling in for both positions as the infant center director and qualified teacher for the toddler classroom due to staff turnover. They are actively hiring staff and looking to fill a teacher position in the toddler classroom. S1 disclosed on Friday in the afternoon the toilet in the toddler classroom suddenly had an overflow. S1 stated they immediately had maintenance shut off the water from the toilet to stop the overflow. S1 stated the licensee called a plumber, the plumber fixed the toilet over the weekend and by Monday the toilet was fixed. S1 stated they do not potty train in the toddler classroom, all infants are in diapers, the sink still had running water, and purified drinking water was available. S1 stated they have never left an aide alone with the children, they are very careful with making sure they are always in ratio. S1 stated on Mondays when S1 is off, Staff #6 (S6) from the preschool center will cover in the toddler classroom for break and lunches. They will also call subs to fill in when they are short staff. In the infant room there are 2 qualified teachers that will also cover in the toddler classroom with an aide.

During the investigation, 6 staff members were interviewed on 6/8/22, 7/7/22 and 7/12/22. Staff #2 (S2) disclosed they do not have any ECE units, but they are never left alone with the children only except during nap time.

However, during naptime there are still teachers present on campus. Staff #3 (S3) stated they have 15 ECE units and over 10 year of childcare experience. Staff #4 (S4) stated they have over 15 ECE units and over 10 years of childcare experience. Staff #5 (S5) stated they took a couple courses in child development but did not qualify as ECE unit and over 1 year of experience working in a preschool. Staff #6 (S6) stated they are teacher qualified for the preschool and infant center. All of the staff disclosed the toilet in the toddler classroom was out of service for a couple days and it was fixed quickly. Five out of Six staff disclosed they have never been out of ratio, S1 is very careful in making sure they are always in ratio. S3 stated on Monday’s when S1 is off they will cover the toddler classroom. S6 stated they mainly work in the preschool center and only assist in the infant center for breaks and lunches. S5 stated there was a couple times when S1 would step outside to throw the trash, but we weren’t out of ratio. Staff #7 (S7) stated they will send S6 to assist in the infant center when they need breaks, or a substitute will assist in the center when short staff or staff will have to stay for overtime when short staff.

On 6/21/22 LPA Odom attempted interviewing 8 parents, however only 6 parents were available for interviews. None of the parents disclosed any concern with the childcare center, they are satisfied with the childcare center. All of the parents disclosed they have observed S1 is always at the childcare center during pick up.
LPA Odom reviewed staff’s personnel records to verify each staff member had qualified ECE units and experience according to regulations. On 5/3/22 during the facility inspection LPA Odom observed the toilet in the toddler classroom was fixed and in working condition.

Based on LPA’s facility inspection, observations, interviews conducted with complainant party, director, 6 staff, and records reviewed it was determined there was insufficient evidence that facility is in disrepair, facility is out of ratio and staff do not have ECE units or experience. Although the allegations may have happened or are valid, there is not a preponderance of evidence to prove the alleged violations did or did not occur, therefore the allegations are Unsubstantiated.

Director stated they immediately verbally corrected S5 when they observed S5 grab C1 from the hands and pull them up and drag them across the room. S5 in no longer employed at the childcare center as of 5/6/22.

Based on interviews with staff, S5 was verbally corrected by S1 on how to properly grab a child and 2 out 5 disclosed that S5 would raise their voice to the children in care. S5 disclosed staff would unintendedly grab children from their hands and pull them up. This is an immediate Health and Safety risk to the children in care.
