Licensing Program Analyst (LPA) Torrence conducted an unannounced complaint inspection on 08/28/2019 to follow up on the complaint investigation that was conducted on 08/13/2019. LPA met with Mrs. Zhang Spring, Principle who guided analyst on a tour of the Early Childhood Setting indoors and outdoors. There were total of 64 children present with nine staff members supervising. During today’s inspection the facility was operating within its licensed capacity and within compliance of staffing ratios. A review of staff records on this date indicated that all facility staff or other individuals who required caregiver background checks have received criminal record and child abuse index clearances or exemptions.
Allegation: Lack of supervision resulting in day care children having access to hazardous materials. Complainant stated that she saw a child playing with an oil diffuser, in one of the classrooms, while staff was present. Complainant reported that the oil diffuser was in an outlet, at the child’s level. On 08/13/2019, LPA Torrence observed an empty oil diffuser laying near an outlet, located on top of the staff sink, near the refrigerator, out of reach of children in care. Three staff members reported that their classroom does have an oil diffuser, which is plugged in an outlet, on top of the teacher’s sink, close to the refrigerator, away from the children. No children were interviewed due to their ages.

Allegation: Classroom operating out of ratio. Complainant stated that one classroom was out of ratio on 07-08-2019 and 07-09-2019. During the investigation, LPA reviewed sign in and out records for children and staff which illustrated that there were sufficient staff to maintain ratio for the days reported. During the staff interviews, there were no disclosure of the classroom operating out of ratio.

Allegation: Co-mingling. Complainant reported that in the morning, there were toddler and preschool children together in the classroom. Complainant stated that comingling occurs in the afternoon also. Complainant stated the staff told her they were approved to comingling in the mornings and evenings. After staff interviews and reviewing the toddler option and preschool children’s daily schedule, there were no disclosure of comingling between the two age groups. Each staff member stated that they complete activities in their own classrooms and conduct outdoor play activities on their own playground.

Based on interviews and documentation obtained there is insufficient evidence to prove if the violations did or did not occur. Although the allegations may have happened or is valid, there is not a preponderance of evidence to prove the alleged violations of lack of supervision resulting in day care children having access to hazardous material, classroom operating out of ratio, and toddler and preschool children co-mingling did or did not occur, therefore the allegations are unsubstantiated.

During today's inspections, there was no deficiency cited per California Code of Regulations, Title 22, Division 12.

Exit interview was conducted. Appeal Rights were discussed. The facility representative was provided a copy of their appeal rights (LIC 9058 12/15) and their signature on this form acknowledges receipt of these rights. Notice of Site Visit was posted during the visit. Facility representative was informed that the notice of site visit must be posted for 30 consecutive days. Failure to post will result in civil penalties of $100.
