Licensing Program Analyst (LPA) Hawkins conducted a follow up investigation on August 6, 2021 at 2:20 p.m. regarding a complaint of personal rights allegation which was initiated on May 18, 2021. During today’s visit LPA provided the complaint findings to the director, Alannah Solorio. At 2:35 p.m. LPA toured the center including all activity/classroom areas, the isolation area, and restroom areas. Current census observed was 7 infants/ 6 toddlers and 5 staff supervising. A review of staff records on this date indicates that all facility staff or other individuals who required caregiver background checks have received criminal record and child abuse index clearances or exemptions.
On May 12, 2021 the Department received a complaint alleging staff used an inappropriate form of discipline with a day care child. It was reported that a staff grabbed a paper from Child #1 (C1), then “threw” C1 on the ground. During the investigation, LPA interviewed six staff, six parents, and reviewed facility records. Staff interviewed reported that physical discipline is not used by any staff. All staff interviewed denied that they have ever interacted with any child in an inappropriate manner, and all staff interviewed denied that they ever observed any other staff member handle children inappropriately. ***continued on page 2***

Staff #1 (S1) reported that concerns about the handling of Child #1 (C1) were brought to their attention after the parent observation of live video in the classroom. S1 reviewed classroom video footage of the time in question. S1 did not observe Staff #6 (S6) handling C1 inappropriately. S1 added that what was observed showed C1 having a tantrum and flopping back while S6 tried to ensure C1’s safety by directing C1 to the carpet and giving C1 space. All staff interviewed denied the allegation. Footage of the classroom was not reviewed by LPA during Licensing investigation due to it being irretrievable after 7 days on the server. S6 no longer works for the facility and was not interviewed after numerous attempts were made to contact S6 by telephone. Children were not interviewed due to age and developmental level. Parents interviewed had no concerns with the care and supervision of the children. The RP was not interviewed after multiple attempts were made by the LPA to contact.

This agency has investigated the complaint alleging that staff used an inappropriate form of discipline with a day care child which is a personal rights violation. We have found that the complaint was unsubstantiated. While the allegation may have happened or is valid, there is not a preponderance of evidence to prove the alleged violation did or did not occur.



Exit interview was conducted with director Alannah Solorio. The Notice of Site Visit was posted. Facility representative was informed that the Notice of Site Visit must be posted for 30 consecutive days. Failure to post will result in civil penalties of $100. Appeal Rights were explained. A copy of their appeal rights (LIC 9058) was given and signatures on this form acknowledges receipt of these rights. All appeals must be in writing and received by the licensing office within 15 business days. The first level appeal is to regional manager; address is above on the report.
