A virtual Informal Meeting was conducted on this day via Zoom. Present during the meeting were Licensing Program Manager (LPM) Rina Lopez, Licensing Program Analysts (LPA) Alanna Gontarek and LPA Dianna Valdez Santana and Director Nichole Ontiveros. Also present during this virtual Zoom meeting was: Regional Supervisor, Denise Olsen, and Sunny Kim, General Manager.

The purpose of this informal meeting was to discuss the facility’s most recent inspections and the deficiencies that have been cited:

101416.5(b) Staff-Infant Ratio: (b) There shall be a ratio of one teacher for every four infants in attendance and Criminal Record Clearance.
On 2/22/2022, LPAs Alanna Gontarek and Dianna Valdez Santana observed 9 infants in the Toddler 'A' classroom with 2 staff. LPAs observed Director remove one child from the Toddler 'A' room, and place child into Toddler 'B' room. During the inspection, it was determined the facility was not operating within compliance of staffing ratios. This violates Title 22 Division 12 Chapter 1 Subchapter 2 Section 101416.5(b). This is an immediate health and safety and personal rights risk to the children in care.

101170(d)(2): Criminal Record Clearance (d) All individuals subject to criminal record review shall, be fingerprinted and sign a Criminal Record Statement (LIC 508 [Rev. 1/03]).
under penalty of perjury. (2) The licensee shall submit these fingerprints to the California Department of Justice, along with a second set of fingerprints for the purpose of
searching the records of the Federal Bureau of Investigation, or comply with Section 101170(e)(1), prior to the individual's employment or initial presence in the child care facility.
On 2/22/2022, during the review of staff criminal record clearance, it was discovered that Robin Cruz (AKA Phillips)staff member in Toddler 'A' classroom did not obtain a criminal record clearance prior to initial presence in the facility. Director provided a copy of the Guardian Employee Roster and the individual, Robin Cruz (Phillips), stated "In process," and not "eligible clearance." LPAs reviewed Licensing Information System (LIS) for employee status, and LIS stated "Overall Status- Pending." Robin Cruz is pending fingerprint clearance and has been working at the facility since 2/14/2022.

Per Director, Cruz worked: 2/14/22, 2/15/22, 2/16/22, 2/17/22, 2/21/22, and 2/22/22. Per Director, Cruz start date was 2/14/2022. Director was unable to provide proof of fingerprint clearance. This is a violation of Title 22 Division 12 Chapter 1 Article # 3 Section 101170(d)(2). A civil penalty of $500 will be assessed today. Director immediately had Cruz leave the premises and stated will have Cruz return once criminal record clearance is obtained.

Licensing Program Staff advised Director, Nichole Ontiveros and Denise Olsen, Regional Supervisor about the Technical Support Program (TSP) regarding compliance. LPA Gontarek provided the TSP brochure via email to the Director and Regional Supervisor. The Director will notify LPA Gontarek if interested in participating in TSP so referral can be made.
A copy of Title 22 Regulations with regards to: Staff-Infant Ratio and Criminal Record Clearance was explained and provided to Licensee and Director via email.
The following was discussed with the Director and Licensee:
1. The licensee was advised that it is her responsibility to know & understand the requirements of Title 22 Regulations.
2. The licensee's facility must be in compliance at all times.
3. The licensee was advised to check the Child Care Licensing web site at www.ccld.ca.gov for quarterly updates, educational/training videos, forms and regulations.
4. Staff training will be conducted for Title 22: Staff-Infant Ratio and Criminal Record Clearance
5. In addition, the licensee is to review the Staff-Infant Ratios video on our website located at https://ccld.childcarevideos.org/family-child-care-providers/
6. Staff attending Step 3 Orientation for training purposes.
7. The licensee will be placed on frequent visits to determine compliance, no longer than two years.

Facility representative was reminded that all adults 18 and over, including employees and volunteers, must obtain a criminal record clearance or exemption, or transfer their existing clearance or exemption, prior to initial presence in a Child Care Center. A civil penalty of $100.00 minimum/day up to $500.00 maximum per day/per person will be assessed if this regulation is violated.

Exit interview was conducted with the Regional Supervisor, Denise Olsen and Director Nichole Ontiveros, whom are in agreement with the above. A copy of the reports were read, explained, and provided to Licensee. A copy this report was sent via email to Director. An electronic read receipt confirms receipt of the report. The facility representative was provided with the mailing address to the Orange County Regional Office (750 The City Drive South, Suite 250 Orange, CA. 92868) and agrees to send a copy of the signed LIC 809 reports by email to LPA and mail originals forms to the office.
