Per Director, Cruz worked: 2/14/22, 2/15/22, 2/16/22, 2/17/22, 2/21/22, and 2/22/22. Per Director, Cruz start date was 2/14/2022. Director was unable to provide proof of fingerprint clearance. This is a violation of Title 22 Division 12 Chapter 1 Article # 3 Section 101170(d)(2). A civil penalty of $500 will be assessed today. Director immediately had Cruz leave the premises and stated will have Cruz return once criminal record clearance is obtained.
Licensing Program Staff advised Director, Nichole Ontiveros and Denise Olsen, Regional Supervisor about the Technical Support Program (TSP) regarding compliance. LPA Gontarek provided the TSP brochure via email to the Director and Regional Supervisor. The Director will notify LPA Gontarek if interested in participating in TSP so referral can be made.
A copy of Title 22 Regulations with regards to: Staff-Infant Ratio and Criminal Record Clearance was explained and provided to Licensee and Director via email.
The following was discussed with the Director and Licensee:
1. The licensee was advised that it is her responsibility to know & understand the requirements of Title 22 Regulations.
2. The licensee's facility must be in compliance at all times.
3. The licensee was advised to check the Child Care Licensing web site at www.ccld.ca.gov for quarterly updates, educational/training videos, forms and regulations.
4. Staff training will be conducted for Title 22: Staff-Infant Ratio and Criminal Record Clearance
5. In addition, the licensee is to review the Staff-Infant Ratios video on our website located at https://ccld.childcarevideos.org/family-child-care-providers/
6. Staff attending Step 3 Orientation for training purposes.
7. The licensee will be placed on frequent visits to determine compliance, no longer than two years.

Facility representative was reminded that all adults 18 and over, including employees and volunteers, must obtain a criminal record clearance or exemption, or transfer their existing clearance or exemption, prior to initial presence in a Child Care Center. A civil penalty of $100.00 minimum/day up to $500.00 maximum per day/per person will be assessed if this regulation is violated.
Exit interview was conducted with the Regional Supervisor, Denise Olsen and Director Nichole Ontiveros, whom are in agreement with the above. A copy of the reports were read, explained, and provided to Licensee. A copy this report was sent via email to Director. An electronic read receipt confirms receipt of the report. The facility representative was provided with the mailing address to the Orange County Regional Office (750 The City Drive South, Suite 250 Orange, CA. 92868) and agrees to send a copy of the signed LIC 809 reports by email to LPA and mail originals forms to the office.
