Licensing Program Analyst (LPA), Mila Quinto conducted an investigation visit to the facility to deliver the findings. LPA met with staff, Savanna Davis. Census was taken. There was a total of 7 preschool children with 2 staff.
A review of facility Personnel Report Summary on this date indicates that all facility staff or other individuals who require caregiver background checks have received criminal record and child abuse index clearances or exemptions.

Facility representative was reminded that all adults 18 and over responsible for administration or direct supervision of staff, persons who provides care and supervision to children, and staff who have contact with children, including employees and volunteers, must obtain a criminal record clearance or exemption, or transfer their existing clearance or exemption, prior to initial presence in a Child Care Center. A civil penalty of $100.00 minimum/day up to $500.00 maximum per day/per person will be assessed if this regulation is violated.

The complainant alleged staff use inappropriate forms of punishment with children. On 10/5/22, LPA interviewed Witness 1 (W1). W1 did not make any disclosures.

On 7/25/22, 10/4/22 and 10/13/22, LPA conducted an interview with 8 staff including the owner. All staff stated they have not witnessed any staff use inappropriate forms of punishment with children. The owner including the staff are trained to meet the children’s needs and help them relax and feel comfortable. A weekly staff meeting is conducted every Friday to cover various topics pertaining to the children in care.

On 10/04/22, LPA called 16 parents and interviewed 8 of the 16 parents. 3 parents interviewed stated they left the school as they heard information on how the owner/director would discipline the children, no other information or specifics were provided. There were no disclosures made from the other 5 parents interviewed. LPA did not receive a return call from the other 8 parents.

On 7/25/22 and 10/20/22, LPA interviewed 8 preschool children. No disclosure made from the 7 preschool children. LPA was not able to qualify 1 preschool child due to limited verbal.

Based on interviews conducted, the complaint alleging staff use inappropriate forms of punishments with children is found to be unsubstantiated. Although the allegation may have happened or is valid, there is not enough preponderance of evidence to prove the alleged violation did or did not occur, therefore the allegation is unsubstantiated.

The complainant alleged staff force children to nap. The complainant stated the Director/owner would put her legs over the children in order to restrict them during nap time. On 10/5/22, LPA interviewed Witness 1 (W1). According to W1, the director also given the instructions to put a staff legs over a child during nap time to restrict them from moving around.

On 7/25/22, 10/4/22 and 10/13/22, LPA conducted an interview with 8 staff members including the owner. According to the owner and director, staff will pat the child on back to help them relax and do not use force during nap time. 1 staff stated part of the director’s training was to have staff put their legs over the child to restrict them from moving during nap time and that it was OK to pat a child’s back with staff’s foot while sending messages to the parents during nap time. Another staff stated this was the training received from another staff member. However, both staff stated that they did not follow this training. There were no disclosures made from the staff members, all staff stated they pat child’s back to help them relax and nap.

On 10/04/22, LPA called 16 parents and interviewed 8 of the 16 parents. 3 parents interviewed stated they left the school as they heard information on how the owner/director would discipline the children and how staff were instructed to put their legs over the child to restrict during nap time. There were no disclosures made from the 5 parents interviewed. LPA did not receive a return call from the other 8 parents.

Based on interviews conducted, the complaint alleging staff force children to nap is found to be unsubstantiated. Although the allegation may have happened or is valid, there is not enough preponderance of evidence to prove the alleged violation did or did not occur, therefore the allegation is unsubstantiated.

Exit interview was conducted. Notice of Site Visit was posted during the visit. Staff was informed that the notice of site visit must be posted for 30 consecutive days. Failure to post will result in civil penalties of $100. Director was provided a copy of their appeal rights (LIC 9058 01/16) and their signature on this form acknowledges receipt of these rights
