On 8/25/21 at 11:00 am, Licensing Program Analysts (LPAs) Laura Mejorado and Blanca Ruiz Silva arrived at the facility to conduct an annual inspection as part of a compliance review. Director, Martha Cisneros has requested to revert license to active status, the inactive license period was effective from 05/08/19 – 08/18/21 and the facility will reopen on 08/26/21. LPAs toured the facility inside and out. There are no children in care today due to the facility reopening on 08/26/21. The following was observed and discussed:

A review of a sampling of the staff records were conducted as part of this evaluation.

The licensee is asked to update the following documents, if applicable, and submit to licensing within 30 days:
1. LIC 500 Personnel Report (Director updated during this inspection)
2. LIC 610 Emergency & Disaster Plan (Director updated during this inspection)
3. Parent Handbook/ Program Curriculum/Admission policies and procedures/ fee schedule (only if changes have been made)

· ZERO TOLERANCE - There are no bodies of water present. All wading pools or similar product must be emptied immediately after use and stored in an upright position.
· ZERO TOLERANCE - No weapons stored at the facility
· Hazards are stored where inaccessible to children which include: disinfectants, cleaning solutions and other items that are dangerous to children.
· Poisons and toxins are locked
· Medications are stored where inaccessible to children
· Classrooms are equipped with age appropriate furniture and equipment in good condition. Furniture and equipment shall be in good condition, free of sharp, loose, or pointed parts.
· Outdoor activity areas are supplied with age and size appropriate equipment in good condition
· Playgrounds are enclosed by appropriate fences and free of hazards
· The surface of the outdoor activity space is free of hazards. Playground is currently under construction. Director will submit waiver to share kindergartner playground.
· All toilets, handwashing, and bathing facilities are in safe and operating condition, at this time.
· All floors were observed to be clean and free from hazards
· Food is stored appropriately and protected from contamination
· All storage containers for solid waste, including moveable bins have tight-fitting covers that were on and in good repair, at this time.
· Uncontaminated drinking water shall be readily available both indoors and out.
· The areas around or under high climbing equipment, swings, slides, and similar equipment shall be cushioned with material that absorbs a fall.
· The Licensee shall ensure the facility is free of flies, other insects and rodents.
· Outdoor activity space surfaces shall be free of hazards.
· Appropriate carbon monoxide detector is present and was tested by the Director during this inspection.
· Licensee/Director understands the Child Care Center shall be clean, safe, sanitary and in good repair at all times to ensure the safety and well-being of children, employees and visitors.
· ZERO TOLERANCE - The Department has inspection authority as specified in Health & Safety Code sections 1596.852, 1596.853, and 1596.8535.
· The Department shall notify a Licensee to immediately terminate the employment of, or to remove/bar any person with specified convictions or for other reasons. The Licensee shall comply with the notice.

· The facility is operating within the terms of the license.
· A review of staff records on 08/25/2021 indicates that all facility staff or other individuals who require caregiver background checks have received criminal record and child abuse index clearances or exemptions.
· A Staff member is present with current Pediatric CPR/First Aid which expires on 09/2021
· Licensee understand the name of the Child Care Center Director or fully qualified teacher(s) designated to act in the Director's absence shall be reported to the Department within 10 days of a change.
· Sign in/Sign out record was reviewed and meets regulation requirements, at this time.
· Each Staff’s files contain the required health screening as specified in section 101216(g). Licensee/Director understands all personnel, including the Licensee, Administrator and Volunteers, shall be in good health and shall be physically and mentally capable of performing assigned tasks.
· Personnel that pose a threat to the health and safety of children shall be relieved of their duties.
· All personnel shall be given on-the-job training or shall have related experience that demonstrates knowledge of and skill in housekeeping and sanitation principles, including universal health precautions.
· The Licensee/Director shall not exceed the conditions, limitations and capacity specified on the license.
· ZERO TOLERANCE - Licensee/Director understands the facility shall ensure no child(ren) shall be left without the supervision, including visual supervision, of a teacher at any time.
· Licensee/Director understands there shall be a ratio of one Teacher supervising no more than 12 children in attendance.
· Licensee/Director shall ensure that each child is accorded a safe, healthful and comfortable accommodations, furnishings and equipment to meet the child's needs.
· The Licensee/Director is responsible for ensuring that children with obvious symptoms of illness including, but not limited to, fever or vomiting, are not accepted.
· The facility is equipped to isolate and care for any child who becomes ill during the day. Room 2-104 will be utilized to isolate and care for ill children.
· Director was advised each child’s file shall contain the required identification and emergency information and medical assessment.
· Menus shall be posted at least one week in advance in a place visible by the child’s authorized
· School District Mandated Child Abuse Reporter training expires on 08/02/2022. Director advised AB1207 is needed. Director will submit to LPA.
· Review of staff records contains proof staff are immunized against influenza, pertussis, and measles. Each employee and volunteer shall receive an influenza vaccination between August 1 and December 1 of each year or provide a statement denying the influenza vaccination.

· AB2370 – Lead Exposure, day care facilities, effective January 1, 2019 - An act amending Sections 1596.866 and 1596.8661 and adding Sections 1596.7996 and 1597.16 to the Health and Safety Code for the education of risks and effects of lead exposure in child care facilities and for the testing of drinking water in licensed child care centers…The bill requires that all Child Care Centers, operating in a building constructed before January 1, 2010, shall have their drinking water tested for excessive lead levels, on or after January 1, 2020, but no later than January 1, 2023. Child Care Centers must thereafter test their drinking water every five years after the date of the initial test…
· AB605 – Child day care facilities, birth to school-age license; Effective January 1, 2021 - The statute…requires the California Department of Social Services (“CDSS” or “Department”) to adopt regulations on or before January 1, 2021 to implement the single center license category and ensure existing health and safety requirements. Before January 1, 2024, all child care centers shall be transitioned to a single center license. Due to the impact of the COVID-19 public health emergency on child care settings, and the need for CDSS’ ongoing efforts to prevent and mitigate the spread of COVID-19 in child care settings and to protect the health and safety of children in care, the adoption of single center license regulations has been delayed and continued delays are anticipated.
· AB2231 (2016) – Increased Civil Penalties, effective July 1, 2017 – For failing to correct a violation the civil penalty is increased to $100 per day for EACH violation until corrected; For failing to correct a repeated violation the civil penalty is increased to $250 immediately assessed, and $100 per day afterwards for EACH repeated violation until corrected; For an Immediate Risk violation the civil penalty is increased to $500 immediately assess, and $100 per day for EACH violation after that until corrected; For any repeated Immediate Risk violations the civil penalty is increased to $1,000 immediately assess, and $100 per day afterwards for EACH repeated violation until corrected. NOTE: Repeat violations are defined as a violation of a previously cited statutory or regulatory Section and/or subsection within 12 months prior.

· The Licensee was informed of their reporting requirements and is provided with the Regional Office’s Unusual Incident Reporting email mailbox: UnusualIncidentReportsDO09@dss.ca.gov

· The Duty Officer is available to answer questions Monday – Friday from 8:00am to 5:00pm at (951)782-4200

No deficiencies were cited during this inspection.

RAST was conducted. Director submitted COVID-19 Self Assessment.

An exit interview was conducted and during the interview, Director, Martha Cisneros confirmed that there are no Registered Sex Offenders living in the facility and/or using the facility address for their mailing address.

A NOTICE OF SITE VISIT WAS ISSUED AND LPA VERIFIED THAT IT WAS POSTED IN A PROMINENT LOCATION AT THE FACILITY BEFORE LEAVING. THE LICENSEE UNDERSTANDS THAT IT MUST REMAIN POSTED FOR THE NEXT 30 DAYS.

This report must be available for review, upon request, for the next three years.
