On 06/29/2023 at 11:07AM, Licensing Program Analyst (LPA) Perla Ordones conducted a required/annual inspection as part of a compliance review. A tour of the inside and outside of the facility was granted and the following was observed and/or noted:

A review of staff and children's records were conducted as part of this evaluation.

The director is asked to update the following documents, if applicable, and submit to licensing within 30 days:

· Classrooms are adequately equipped with age and size appropriate furniture and equipment and free of hazards.
· There are no weapons present at the facility as stated by Director Lyndsay Hunter.
· There are no accessible bodies of water present. All wading pools or similar product must be emptied immediately after use and stored in an upright position.
· Present for supply drinking water in the indoor activity space.
· Medications are not provided or administered by the facility per Director. No IMS plan on file for the facility.
· Hazards are stored where inaccessible to children which include: Disinfectants, cleaning solutions and other items that are dangerous.
· Poisons and toxins are locked.
· All floors shall be clean and safe.
· Bathrooms were observed to be safe, sanitary and in operating condition.
· Playgrounds are enclosed by appropriate fences and free of hazards.
· Outdoor activity areas are supplied with age and size appropriate equipment not in good condition. During facility tour, LPA observed two Lakeshore tricycles outside which were not maintained in good condition. One of the tricycles was missing a pedal and another tricycle was missing a handlebar which left the metal exposed which is a concern with the growing heat. Director immediately removed tricycles from the play area and stored the tricycles in an inaccessible area to children. Director stated that the licensee is currently in the process of obtaining new tricycles for the children.
· Food preparation area is clean, free of litter, rubbish and free of rodents and other vermin. Director stated that the kitchen area located at the facility is for staff use only as the facility does not provide food for children. Director stated that children bring food from home to eat for lunch.
· Food is stored appropriately and protected from contamination.
· All storage containers for solid waste, including moveable bins shall have tight-fitting covers that are kept on, and in good repair.
· Menus shall be posted at least one week in advance in a place visible by the child’s authorized representative, dated and kept on file for 30 days, and made available upon request.
· Uncontaminated drinking water shall be readily available both indoors and outdoors. According to the Director, drinking water is provided to children via disposable water cones and tap water indoors. Meanwhile, water fountains are available outside for children to use as needed.

· The areas around or under high climbing equipment, swings, slides, and similar equipment shall be cushioned with material that absorbs a fall. The facility utilizes sand as the material that cushions high climbing equipment.
· Sign in/Sign out record was reviewed and meets regulation requirements.
· A Staff member is present with current Pediatric CPR/First Aid which expires on 03/2025.
· Opening and closing staff member’s CPR/First Aid expires on 03/2025.
· Director completed Health and Safety Training – 02/28/2021.
· Disaster drills to be conducted every six months – last fire drill conducted on 06/22/2023 and last earthquake drill conducted on 06/12/2023.
· A review of children’s records was conducted, and records were found to be complete during this inspection.
· A review of staff records indicates that all staff present meet minimum qualifications for the position for which they were hired. However, records were found to not be complete during this inspection. During record review, LPA observed S3 and S4 to be missing proof of valid Mandated Reporter Child Care Providers Training (AB1207). LPA brought this to the attention of the Director who agreed to have staff complete the training by the agreed upon date.
· A review of staff records on 06/28/2023 indicates that all facility staff or other individuals who require caregiver background checks have received criminal record and child abuse index clearances or exemptions. However, during the inspection LPA found that S1 was not associated to the facility though they did have eligible fingerprint clearance. It was discovered that S1 is associated to the sister facilities of First School of the Desert, the ones located in Cathedral City and Palm Desert, but not the location in Palm Springs. LPA brought this to the attention of the Director who immediately had S1 associated to the correct facility and provided proof to LPA during this visit.

CCC COMPLETED TESTING AND NO LEAD EXCEEDANCES:
Assembly Bill (AB) 2370, Chapter 676, Statutes of 2018, requires all licensed Child Care Centers (CCCs) constructed before January 1, 2010, to test their water (used for drinking and food preparation) for lead contamination before January 1, 2023, and then every 5-years after the date of the first test.

For child care center licenses issued after July 1, 2022, the licensee shall test their water for lead within 180 days of licensure pursuant to Written Directives section 101700 (PIN 21-21.1- CCP).

LPA verified that the lead testing was completed in accordance to the Written Directives outlined in PIN 21-21.1-CCP.

LPA discussed the safe sleep regulations with Director and discussed the Child Care Licensing Safe Sleep webpage at https://www.cdss.ca.gov/inforesources/child-care-licensing/public-information-andresources/safe-sleep as an additional resource. LPA also informed Director of the importance of checking for recalled infant devices on the United States Consumer Product Safety Commission (CPSC) website at https://www.cpsc.gov/ and recommended they register all infant devices with the CPSC to be notified of any recalls on their purchased equipment.

Incidental Medical Services (IMS) policy was discussed. For IMS information see PIN 22-02- CCP. When any IMS is provided, an updated Plan of Operation that includes IMS must be submitted to the Department. Director was reminded that all adults 18 and over, including employees and volunteers, except as specified in Health and Safety Code section 1596.871, must obtain a criminal record clearance or exemption, or transfer their existing clearance or exemption, prior to initial presence in a Child Care Center. A civil penalty of $100.00 minimum/day for a maximum of 5 days or, if the penalty is for a repeat violation, for a maximum of 30 days per person will be assessed if this regulation is violated.
