At 8:45am on March 14, 2022, Licensing Program Analyst (LPA) Alaina Wilburn conducted an unannounced complaint inspection. LPA met with Assistant Director Veronica Tuker, to deliver findings on the above stated allegation.

Investigation consisted of an initial inspection on 02/03/2022, and a subsequent inspection on 03/02/22, and interviews with Principal and Assistant Director (AD). In addition, LPA reviewed declarations from two staff and conducted a review of Child #1's (C1) file.

On 01/27/2022, a complaint allegation was received by the Community Care Licensing (CCL) office that staff did not prevent day care children from engaging in inappropriate behaviors. During an interview with AD, she disclosed that on the evening of 01/04/22, an incident occurred where C1 and Child #2 (C2) had markers and paper and were coloring. There were two staff present, but C1 and C2 still managed to color on their bodies. Later in the evening, C2's parent contacted AD and advised that C2 had color marks on their private parts.

AD talked to both children and staff about the incident. Staff deny observing C1 color on C2's private parts. C2 stated that C1 did color on their private parts. C1 denied coloring on C2's private part but did acknowledge coloring on C2's bottom and inner thigh. Child #1's childcare services with the facility were terminated on 01/07/2022; therefore, LPA was unable to interview child.

Based on interviews conducted and record reviews, the preponderance of evidence standard has been met and the allegation that staff did not prevent day care children from engaging in inappropriate behaviors is found to be SUBSTANTIATED. The facility is being cited in accordance with Title 22 Child Care Center Regulations, Division 12, Chapter 1, Section 101229(a)(1): Responsibility for Providing Care and Supervision. This posed an immediate risk to the health, safety or personal rights risk to the children in care. See LIC9099D for cited deficiency.

Exit interview conducted. A copy of this report and appeal rights were discussed and provided to the Assistant Director Veronica Tuker on this date.

A NOTICE OF SITE VISIT WAS ISSUED AND LPA VERIFIED THAT IT WAS POSTED IN A PROMINENT LOCATION AT THE FACILITY BEFORE LEAVING. THE LICENSEE UNDERSTANDS THAT IT MUST REMAIN POSTED FOR THE NEXT 30 DAYS.

(1) No child(ren) shall be left without the supervision of a teacher at any time, except as specified in Sections 101216.2(e)(1) and 101230(c)(1). Supervision shall include visual observation.

Assistant Director Veronica Tuker advised they had a meeting with staff on 03/13/22 to discuss active supervision. We had different stations in the lassrooms and outdoors to work on demonstration. We will be hiring a third evening Aide for assistance with active supervision. Also, we invested in walkie talkies, so staff could communicate through

Based on interviews conducted and record review, staff failed to supervise/observe children in that on 1/04/22, C1 colored on C2's private parts, which posed an immediate health, safety or personal rights risk to children in care.

walkie talkies instead of cellphones. We have adapted a "No Cellphone policy during work hours. LPA was provided with a copy of documentation from meeting and a Sign-IN sheet of all staff present during meeting/training.
