On 08/17/2021 at 2:04 pm, Licensing Program Analysts (LPAs) Laura Mejorado and Destinee Hogue arrived at the facility to deliver the findings of this complaint investigation which was initiated on 07/14/21. The complaint alleging personal rights violations was investigated by Community Care Licensing Investigations Branch, Investigator Lori Wood. It was alleged neglect/lack of supervision resulted in a child requiring medical attention from being found unresponsive in a pool of water. LPAs met with Directors Angela Morway and Druscilla Craven. LPAs toured the facility, obtained documentation, obtained measurements, took photographs, took census, and discussed the following with the Directors.

During the course of the investigation, Investigator Wood conducted interviews and obtained information from all relevant individuals pertinent to the investigation. Based on the investigation, interviews, and collaboration with other agencies, it was determined there was a violation of Title 22 Regulations, pertaining to the complaint.

The evidence gathered during the investigation corroborates the allegation that on July 13, 2021, there was neglect/lack of supervision which resulted in a child requiring medical attention from being found unresponsive in a pool of water. Based on eyewitnesses observations, multiple interviews, record review, and collaboration with other agencies, the preponderance of evidence standard has been met, therefore the above allegation is found to be SUBSTANTIATED. California Code of Regulations, Title 22, Division 12, Chapter 1, are being cited on the attached LIC 9099D. An enhanced civil penalty determination is pending.

An exit interview was conducted with the Directors, Appeal Rights were discussed and issued, a copy of this
report was provided, and a Notice of Site visit was issued.

Upon receipt of this report, the Directors shall post the Notice of Site Visit and any Licensing report
documenting a type “A” deficiency. The report and the Notice of Site Visit shall be posted for 30 consecutive
days. Failure to maintain posting as required, will result in an immediate $100 civil penalty. A copy of this
report shall be provided to the parent/guardian of children currently enrolled by the next business day or
immediately upon return. A copy of this report shall also be provided to the parent/guardian of any newly
enrolled children for the next 12 months (1 year). The Acknowledgement of Receipt (LIC 9224 form must be
maintained in each child’s file immediately upon receipt from parent. Licensee was provided with a copy of the Acknowledgement of Receipt of Licensing Reports (LIC 9224).

A copy of this report must be made available for the next three years.

The evidence gathered during the investigation corroborates the allegation that on July 13, 2021 there was neglect/lack of supervision which resulted in a child requiring medical attention from being found unresponsive in a pool of water for approximately 3 minutes, facility staff did not provide visual supervision during water play activities, resulting in a near drowning, which posed an immediate risk to the health, safety, and personal rights of the subject child and to other children in care. An enhanced civil penalty determination is pending.
