25 | Licensing Program Analyst (LPA) Sharleen Robinson arrived at the facility, for the purpose of conducting a case management follow-up visit; regarding an unusual incident report that was submitted by the facility on February 20, 2020. LPA met with Directors Brandie Rubalcaba to discuss the reported incident. There were 50 preschool children in care. LPA conducted interviews, took census and reviewed records.
The Director self reported, that on about February 19, 2020 at approximately 3:00PM it was brought to their attention that a staff member was being filmed by a representative being rough with a child, it was reported that the staff member was holding the child by their arm and shaking him/her.
The Directors conducted an internal investigation; the assistant Director made observations and did not observe a staff member being rough with a child/ holding the child's arm or shaking the child. The Director interviewed facility staff and obtained declarations. The Director contacted the child's representative and reported the alleged incident. The child's representative dis-enrolled the child from the facility. The police department was notified, no further action was taken as they did not find any violations related to the alleged allegation.
During interviews it was disclosed that a staff member was not shaking a child or being rough with the child. It was also disclosed that a staff member was redirecting the child who was throwing his/her self on the floor, the staff member admits to using a stern raised voice with the child but denies being rough or hitting the child. In contrast it was disclosed that a staff member was observed being rough with a day care child, pulling their arm, roughly sitting the child down roughly and screaming at the child. The representative reportedly recorded the staff member walking with the child and holding their hand, however they did not film the staff member being rough with the child. The recording was not available for LPAs to review. A pertinent individual was not available to participate in the interview.
Based on the information obtained during the visit, LPAs could not determine if their was a violation of Tittle 22 regulations. The director agrees to have an in-service training with all staff regarding personal rights by March 31, 2020. No deficiencies sited at this time. An exit interview conducted and a notice of site visit provided to the director. |
