On October 15, 2024, at 10:16 AM, Licensing Program Analyst (LPA), Courtnee Peebles arrived unannounced to KINDERCARE LEARNING CENTER (CCC) and met with Director, Blanca Flores to discuss the investigative findings of the allegation listed above. During the investigation, LPA conducted confidential interviews with three staff (D, S2, and S3), and four parents (P1, P2, P3, and P4) and obtained documents pertinent to the investigation.

On August 21, 2024, a complaint was received alleging that staff at the daycare discriminated against children and parents based on skin color, Staff speaks inappropriately of day care children. Staff does not treat day care children with dignity or respect. Staff does not ensure facility is kept clean, and Facility is operating out of ratio. Specifically, some parents felt that "write-ups" and other minor issues were linked to their or their child’s skin color. treat day care children with dignity or respect. Interviews with parents revealed that some believed their children were treated differently than others with similar behavioral issues but of different skin colors. One incident was cited, where a child allegedly received a write-up for making a derogatory remark, although the child was neither involved in the situation nor made the remark. Additionally, some parents expressed concerns that their calls were being avoided by the director, who they believed always had an excuse not to speak with them, possibly due to the color of their skin. 1 of 3 staff interviews revealed that while some staff acknowledged overhearing inappropriate remarks made by a former staff member, that individual is no longer employed at the center. No current staff members were found to have engaged in discriminatory behavior.

Regarding allegations, facility operates out of ratio and Staff does not ensure facility is kept clean. Three of five confidential interviews disclosed there are no issues with the center operating out of ratio and they have not been out of ratio. Two of five interviews disclosed staff may be out of ratio for five minutes during transitions, but they are always assisted to ensure ratios are met. All interviews revealed that when teachers/classrooms are approaching going over ratio, especially during transitions, the center will bring in other staff to ensure ratios are met, interviews with staff revealed, staff are responsible for cleaning the CCC daily before the end of their shift. Staff do not deny the CCC could be cleaner, but they work as a team cleaning during nap time and small breaks in the day. Additionally, interviews disclosed that there have been times when staff is left with only a few children at the end of the day and the staff is having to clean the room alone.

Based on interviews, record review and observations, LPA is unable to corroborate the Staff discriminate against daycare children and parents. Although the allegations may have happened or are valid, there is not a preponderance of evidence to prove the allegations did or did not occur, therefore the allegations are unsubstantiated.

An exit interview was conducted and a copy of this report along with the appeal rights were provided to Director, Blanca Flores. A notice of site visit was handed to licensee and must remain posted for 30 days.
