On May 28, 2025, at 1:15PM, Licensing Program Analyst (LPA) William Chancellor arrived unannounced at St. Jeanne de Lestonnac School (CCC) and met with Director Erna Cortez to discuss the investigative findings regarding the allegation noted above. As part of the complaint process, LPA conducted two visits—one on April 15, 2025, at 10:00 AM, and a follow-up visit on April 29, 2025, at 3:30 PM. During the investigation, LPA made observations at the facility, conducted a census, interviewed five staff members (S1–S5) confidentially, and requested documentation relevant to the investigation.
The complaint, received on April 14, 2025, alleged that staff failed to prevent daycare children from engaging in inappropriate interactions. Specifically, it was reported that Child 1 (C1) made concerning comments at home, stating that they wanted to "kiss their privates because it tickles." Upon further questioning, C1 disclosed that Child 2 (C2) had kissed their privates in the playground restroom at school.

As part of the investigation, LPA inspected the girls' playground restroom. It was observed that the CCC staggers lunch by classroom in fifteen-minute intervals, allowing one class to finish before the next begins and uses the restroom for handwashing. All six interviewed staff confirmed that classroom restrooms are used by one child at a time and that the playground restroom is supervised after lunch during routine handwashing. Furthermore, five of five staff interviews supported the assertion that the restroom is only used briefly and under supervision, making it unlikely that sufficient time would have elapsed for such an incident to occur. LPA’s direct observation confirmed that the girls’ playground restroom remains under active supervision when a staff member is stationed in Zone 1. It should also be noted that both C1 and C2 continue to attend CCC, and that parent volunteers are present during lunch and recess.

Due to conflicting statements and a lack of sufficient evidence, LPA is unable to corroborate the allegation that staff failed to prevent inappropriate interactions between daycare children. Although the incident may have occurred, there is not a preponderance of evidence to prove or disprove the allegation. Therefore, the allegation is deemed unsubstantiated.

An exit interview was conducted, and a copy of this report, along with appeal rights and a Notice of Site Visit, was provided to Director Erna Cortez. The Notice of Site Visit must remain posted in a prominent and visible location for 30 consecutive days, accessible to families and caregivers.
