32 | It was reported, on or about mid-September of 2022, that daycare children engaged in inappropriate behavior. It was alleged that a child accused another child of inappropriately touching them. During interviews conducted, staff denied the allegation and indicated that the facility is always in child to teacher ratio, the children are always supervised, and there has been no inappropriate touching observed by staff; specifically involving the subject children.
During children interviews, and based on the ages of the children allegedly involved, LPA was unable to obtain pertinent information or evidence relating to the allegation. Additionally, there were no known witnesses to the alleged incident. During other interviews, it was disclosed that one of the children had an unexplained rash that had been ongoing during the time this incident was reported. Although there was a disclosure that a child was touched on their "private" by another child, it was later stated that "it was an accident", therefore there was no information or documentation that corroborated or negated the allegation.
LPA was unable to obtain corroborating information related to the incident surrounding the allegation, that daycare children engaged in inappropriate behavior, therefore the allegation is UNSUBSTANTIATED.
Based on information obtained during this investigation and through interviews conducted, the review of pertinent documentation, and after receiving conflicting information, the allegation is UNSUBSTANTIATED. A finding that the allegation is unsubstantiated means that although the allegation may have happened or is valid, there is not a preponderance of evidence to prove that the allegation occurred.
An exit interview was conducted with the assistant director, Taylor Elms. Appeal Rights were discussed and issued, a copy of this report was provided, and a Notice of Site (NOS) Visit was issued.
The Notice of Site Visit (LIC9213) shall be posted where the parent/guardian of children enter and exit the facility. The Notice of Site Visit (LIC9213) must remain posted for 30 days during the hours of operation after each site visit by a licensing representative. Failure to maintain posting as required will result in a civil penalty of $100.00
A copy of this report must be made available for the next three years. |
