32 | LIC9099C Pg. 2, Unsubstantiated: It was alleged that facility staff handle children in a rough manner, when a subject staff was observed grabbing daycare children by the arms while entering a classroom and grabbing a subject child by the wrists roughly as a form of discipline on 05/28/2025. The LPA conducted a review of records, made observations and conducted interviews with pertinent parties relevant to the investigation which revealed the following: Pertinent parties interviewed did not corroborate the allegation and denied a staff pulls daycare children by the arms or that a subject staff grabbed a subject child by the wrists.
On 06/02/2025 the agency director Ivamae Haney, self reported the incident by phone and followed up with a written report, submitted to the department. On 06/04/2025 the LPA initiated the investigation. Iinterviews with pertinent parties stated a staff was observed assisting children into the classroom by holding children’s hands, at which time a subject staff was in the process of preventing a subject child from falling to the ground. The parties denied any rough handling of children. In addition, the LPA interviewed additional potential witnesses present on the date and during the time frame of the alleged incident. All parties interviewed denied witnessing a subject staff or other staff rough handle the children.
During the investigation, it was determined that the reporting party was not a direct witness to the incident. The LPA was denied approval to interview a pertinent party said to be involved in the incident. In addition, another potential witness relevant to the investigation did not respond to the LPA's attempt to interview, regarding the allegation.
During the investigation the LPA did not observe of violations of staff caring and supervising children. The agency followed Title 22 Regulation's Reporting Requirements by self-reporting the incident on 06/02/2025. Based on LPA observations, review of records, inability to interview other pertinent parties and conflicting statements obtained during the investigation, the allegation is determined to be unsubstantiated.
Although the allegations that facility staff handle children in a rough manner may have happened or is valid, there is not a preponderance of evidence to prove the alleged violation did or did not occur, therefore the allegation is UNSUBSTANTIATED.
