On October 11, 2023, Licensing Program Analyst's (LPA's) Lorena Valenzuela and Cindy Hamilton conducted an unannounced inspection at Kindercare Learning Center and met with Assistant Director Andrea Cumpen. The purpose of the inspection was to deliver the findings on the above stated allegation. The investigation included an inspection of the facility and review of documents on 09/26/2023 and 09/29/2023. In addition, LPA Valenzuela interviewed Assistant Director, Director and seven staff.

On September 22, 2023, Community Care Licensing (CCL) received information facility staff did not treat daycare children with respect. It was reported Staff #1 (S1) would make inappropriate comments to children in care after they had accidents in respect to their toileting needs.

Confidential interviews revealed Staff 1 made several inappropriate comments after children had toileting accidents, comments which were heard being said to children by several witnesses.

Based on interviews and records review, the preponderance of evidence standard has been met, and the allegation facility Staff 1 did not treat children with respect is substantiated. The facility is cited under Title 22, Section 101223 (a) (1) Personal Rights. See deficiency report for citation cited.
An exit interview was conducted, and a copy of this report, LIC 9099-D, and appeal rights was provided to Andrea Cumpen, Assistant Director.
The Notice of Site Visit was provided, the licensee was reminded this notice must be posted for 30 days.

Assistant Director agrees to provide to all staff in preschool room training about positive reinforcement/communication regarding childrens diapering and toileting needs. Will provide documentation of the training provided to the Department by due date 10/27/2023.

Based on interviews and records review, facility Staff 1(S1), did not treat day care with respect due to S1 made inappropriate comments to day care children when they had toileting accidents. This poses a potential health, safety or personal rights risk to the children in care.

On October 11, 2023, Licensing Program Analysts (LPA's) Lorena Valenzuela and Cindy Hamilton conducted an unannounced inspection at Kindercare Learning Center and met with Director Tara Martinez. The purpose of the inspection was to deliver the findings on the above stated allegation. The investigation included an inspection of the facility and review of documents on 09/26/2023 and 09/29/2023. In addition, LPA Valenzuela interviewed Assistant Director, Director and seven staff.
On September 22, 2023, Community Care Licensing (CCL) received information facility staff yelled at day care children. Confidential interviews resulted in conflicting statements being provided to LPA Valenzuela. Witness statements indicated Staff 1 does not yell at children but uses a firm voice, when needed, to get the attention of the children. Other information received indicated Staff 1 does yell at children in care.
Based on interviews and records review, the allegation that staff yelled at day care children, may have occurred, however is not supported or proven by evidence. Therefore, the allegation is unsubstantiated at this time.
