On March 25, 2024 at 4:15 pm, Licensing Program Analysts (LPA), Jessica Rubio and Gabriela Hernandez arrived at Kindercare Learning Center (CCC) to deliver the investigative findings of the allegations listed above. LPAs met with Director Tara Martinez. On February 23, 2024 at 1:00 pm, LPA conducted a tour and census of the CCC. LPA did not observe any violations at the time of the visit and all classes were in ratio. During the investigation, LPA conducted confidential interviews with Director and three staff (S1, S2 and S3).

On February 16, 2024, a complaint was received alleging staff does not provide adequate supervision resulting in a child being injured by another child; specifically, that C1 sustained scratches from another child(ren) while at the CCC. Additionally, the complaint alleged a classroom operating out of ratio; specifically, the two year old classroom had an unknown amount of children or approximately 14 children at pick up time, with one staff providing care.

Regarding the allegation that staff does not provide adequate supervision resulting in C1 being scratched by another child(ren), record review revealed C1 attended the CCC from August 2023 through January 2024. During the investigation, LPA received documentation of photographs of C1 with a scratch mark on C1’s face and scratch marks on C1’s wrist dated 9/19/2023, a scratch mark on C1’s face on 9/27/2023 and a scratch mark on C1’s face on 10/24/2023. Additionally, documentation and interviews revealed that inquiry and photos of C1’s above mentioned scratches were sent to the CCC on those dates. However, interviews and documentation revealed no staff were aware, had viewed the photos or responded to the messages. Confidential interviews with staff revealed that C1 had incidents where C1 would scratch and hit or attempt to scratch and hit other children, however, C1 was not seen to have any incidents with other children scratching C1 while at the CCC. Additionally, C1 did not make it known to any staff that C1 had been scratched while at the CCC. Interviews revealed on one occasion, when C1 arrived to the CCC a scratch mark on C1’s face was verbally brought to the attention of Director and S3. It was alleged the scratch occurred the day before, however. no staff observed any incident which would have caused scratch marks to C1’s face.

Regarding the allegation that facility is operating of ratio, interviews revealed that the facility does not have an issue with staffing or remaining in ratio in the Two year old class. In addition, each time LPA visited the facility, the Two year old class, as well as other classes were in ratio.

Based on photographic evidence, C1 did sustain scratches, however, it could not be determined how or where the scratches occurred therefore, the allegation staff does not provide adequate supervision resulting in C1 being scratched by another child(ren), may have occurred, however, is not supported or proven by evidence. Based on interviews conducted and observations, the allegation that the Two year old classroom is operating out of ratio, may have occurred, however is not supported or proven by evidence. Therefore, the above allegations are unsubstantiated. An exit interview was conducted and a copy of this report and appeal rights were discussed and provided to Director Tara Martinez. A notice of site visit was also provided and must remain posted for 30 days.
