On October 11, 2023, Licensing Program Analyst's (LPA's) Lorena Valenzuela and Cindy Hamilton conducted an unannounced inspection at Kindercare Learning Center and met with Assistant Director Andrea Cumpen. The purpose of the inspection was to deliver the findings on the above stated allegation. The investigation included an inspection of the facility and review of documents on 09/26/2023 and 09/29/2023. In addition, LPA Valenzuela interviewed Assistant Director, Director, seven staff, eight children and two parents.

On September 21, 2023, Community Care Licensing (CCL) received information that facility staff made day care children clean the facility vehicle. It was reported there were staff and several children washing the facility vehicle in the facility’s parking lot, which the facility shares with a retail business.
Witness interviews conducted revealed in July 2023, the facility staff had the school age class wash the outside of the facility bus, in addition to having children help clean and sweep inside of the vehicle. Interviews conducted revealed, as part of water play, the Director asked facility staff to have the children wash the vehicle and provided supplies, such as bucket with soap and water, rags and water hose.

Witness statements revealed most children would not want to wash the facility vehicle again and would prefer to participate in another water play activity.
Additional interviews revealed parents were not notified ahead of time that their children would be participating in this type of water play activity. Confidential interviews revealed, children were not given the choice whether to participate or not and they saw the activity as a chore and preferred not to wash the facility vehicle.
Based on interviews and records review, the preponderance of evidence standard has been met, and the allegation facility staff made day care children clean facility vehicle is substantiated. The facility is cited under Title 22, Section 101223 (a) Personal Rights. See deficiency report for citation cited.
An exit interview was conducted, and a copy of this report, LIC 9099-D, and appeal rights was provided to Andrea Cumpen, Assistant Director.
The Notice of Site Visit was provided, the licensee was reminded this notice must be posted for 30 days.

Assistant Director Andrea Cumpen agrees to submit a written statement to the Department in regards to how the facility will proceed in the future in regard to activities that are not conducted within the facility grounds.
