32 | corroborate the allegation with a preponderance of evidence. It was disclosed during interviews that facility staff does not utilize restraining as a form of disciplinary action, but instead, utilize redirection and calming techniques to assist with modification of childrens’ behaviors. Therefore, based on the information obtained, the allegation is UNSUBSTANTIATED.
In regards to the allegation staff inappropriately expelled child from school, information obtained during confidential interviews could not corroborate this allegation. Interviews with facility staff revealed that C1’s childcare services were terminated due to the child demonstrating challenging behaviors such as aggression, tantrums, and noncompliance that could jeopardize the safety of other students and/or staff. It was also revealed that facility staff provided C1’s responsible party with resources and support during meetings conducted, that would help to nurture positive social-emotional development for the child, and thus provided a process aimed at supporting the child and family prior to terminating C1’s childcare services. Additionally, a review of child #1's (C1s) records by LPA King contained six (6) Behavior Reports between the months of August 2021-November 2021 of the child being aggressive towards staff and other children. Additionally, during the course of this investigation, LPA King reviewed the signed Admissions Agreement for C1, which indicated that “disrespect to the personnel of the school, or continued disobedience to the established policies of the school would not be tolerated.” The review of these records and C1’s records revealed that the facility followed their policies and procedures in their Admissions Agreement/Parent Handbook as it relates to the termination of childcare services. Therefore, based on the evidence obtained, the allegation staff inappropriately expelled child from school is UNSUBSTANTIATED.
In regards to the allegation staff scream at daycare children, confidential interviews conducted with staff and children could not corroborate this allegation with a preponderance of evidence. Additionally, during visits conducted during the investigation, LPA King did not hear/observe any teachers/staff members yelling or screaming at the children. Therefore, based on the evidence collected, the allegation staff scream at daycare children is UNSUBSTANTIATED.
Based on the lack of witnesses and conflicting statements obtained during confidential interviews, there is no evidence to prove or disprove that staff restrained a daycare child, staff inappropriately expelled child from school, and staff scream at daycare children.
