On the date and time listed, Licensing Program Analyst (LPA) Nasha King arrived at the facility for the purpose of concluding and delivering the complaint findings into the investigation of the above-referenced allegations. LPAs toured the facility, conducted census, and discussed with Ms. Markham the conclusion of the complaint investigation.
An initial 10-day visit was conducted on 01/05/2022, and the investigation was extended at that time. During an additional visit conducted on 03/03/2022, LPA King reviewed children’s records, specifically child #1’s (C1) file and conducted interviews with staff pertinent to the investigation; the investigation was also extended during this visit.
On 01/04/2022, Community Care Licensing (CCL) received a complaint alleging that a child sustained head injury, administrator did not report an unusual incident to a daycare child's representative, staff denied daycare children more food when they said they were still hungry, and facility is in disrepair.

In regards to the allegation that child sustained head injury, confidential interviews could not corroborate the allegation as LPA received conflicting information. LPA reviewed child #1’s (C1) file and observed a total of seven (7) Ouch Reports. Of the seven (7) reports, none of them reported that C1 sustained a head injury. Per the Director, when a child sustains a head injury, the child’s parent(s) or authorize representative(s) are notified immediately via telephone of the injury, stating that anything that has to deal with the head, they always urge the parent(s) to take the child to see a doctor to seek medical attention due to the nature and/or seriousness of the injury. Additionally, an interview conducted with staff #1 (S1), who witnessed the injury, revealed that C1 did not sustain a head injury, as C1 was running and fell and scraped their nose outside on the turf. Therefore, based on the information obtained, the allegation child sustained head injury is UNSUBSTANTIATED.

In regards to the allegation administrator did not report an unusual incident to a daycare child's representative, information obtained during confidential interviews could not corroborate this allegation. LPA reviewed C1’s record and did not observe an Ouch Report documenting a head injury, and therefore, there was not anything to report to the guardian. Per the Director, parents/authorized representatives are notified of all unusual incidents with an Ouch Report. Specifically, when it comes to any head injuries, parents/authorize representatives are notified immediately via telephone. The parents/authorize representatives are notified so that the child can be picked up and taken to seek medical attention because they understand the seriousness of any head injury and wants to make sure that the child seeks proper care. Therefore, based on the information obtained and records review, the allegation is UNSUBSTANTIATED.

In regards to the allegation staff denied daycare children more food when they said they were still hungry, confidential interviews conducted with staff and children could not corroborate this allegation. Interviews revealed that children are not being denied food, and when asking for more food, staff are more than willing to give the children additional servings, including snacks. During today’s visit, LPA King observed that the menu was posted and reviewed the March 2022 School Snack/Lunch Menu. LPA observed that children who receive the school lunches were served the foods on today’s menu. Additionally, LPA observed the children’s plates to have large portions of the food being served and met the threshold for the quantity necessary. The children who bring their lunches from home had large portions of their food as well. Interviews also revealed that there is always extra food for the children. cheese, peas, and fruit (Room 3) and an “extra” large-sized bowel (Room 1) of mac & cheese to provide to the children if they were still hungry and ask for more servings. Therefore, based on the information obtained and LPA’s observation, the allegation is UNSUBSTANTIATED.

In regards to the allegation facility is in disrepair, LPA has been to the facility a total of seven (7) times during the following months of December 2021- March 2022. During the facility tours, LPA also conducted physical plant inspections and during these inspections, LPA has observed the facility (inside and out) to be orderly and in good repair. More specifically, it is alleged that the playground has a “deep hole in the concrete,” the “playground also has fallen limbs and debris from a neighbor’s fallen tree”, and “during outside play, the children are poking each other in their eyes with the limbs.” It was also disclosed that the Director has been informed about the tree and the playground but will not have it cleaned. Cornerstone Christian Preschool have two playgrounds, and LPA observed that both playgrounds were clean and orderly. LPA did not observe any hazardous or unsafe items on neither of the playgrounds nor were there any observations of a deep hole in the concrete. Per the Director, the facility grounds are checked every morning, stating that inspection checks are conducted on both outdoor play areas because sometimes the wind blows things over to the play area or even sometimes the neighbors can throw things over by accident. The Director stated that anything that does not belong on the playground is immediately removed. LPA inquired about a tall tree that was observed with several limbs that hover over the toddler playground, and the Director advised LPA that the limbs were going to be cut and the branches were going to be trimmed back so that they do not hang over the playground area. Per the Director, the tree trimming project will be conducted on Friday, March 25, 2022. However, interviews revealed that until this project is completed, any limbs or debris that falls onto the playground area will be immediately removed and/or thrown away. Therefore, based on the information obtained and LPA’s observations, the allegation is UNSUBSTANTIATED.

Based on the lack of witnesses and conflicting statements obtained during confidential interviews, there is no evidence to prove or disprove that a child sustained head injury, administrator did not report an unusual incident to a daycare child's representative, staff denied daycare children more food when they said they were still hungry, and facility is in disrepair.

Although the allegations may have happened or is valid, there is not a preponderance of evidence to prove that the alleged violations did or did not occur, therefore the allegations are UNSUBSTANTIATED.
