32 | cheese, peas, and fruit (Room 3) and an “extra” large-sized bowel (Room 1) of mac & cheese to provide to the children if they were still hungry and ask for more servings. Therefore, based on the information obtained and LPA’s observation, the allegation is UNSUBSTANTIATED.
In regards to the allegation facility is in disrepair, LPA has been to the facility a total of seven (7) times during the following months of December 2021- March 2022. During the facility tours, LPA also conducted physical plant inspections and during these inspections, LPA has observed the facility (inside and out) to be orderly and in good repair. More specifically, it is alleged that the playground has a “deep hole in the concrete,” the “playground also has fallen limbs and debris from a neighbor’s fallen tree”, and “during outside play, the children are poking each other in their eyes with the limbs.” It was also disclosed that the Director has been informed about the tree and the playground but will not have it cleaned. Cornerstone Christian Preschool have two playgrounds, and LPA observed that both playgrounds were clean and orderly. LPA did not observe any hazardous or unsafe items on neither of the playgrounds nor were there any observations of a deep hole in the concrete. Per the Director, the facility grounds are checked every morning, stating that inspection checks are conducted on both outdoor play areas because sometimes the wind blows things over to the play area or even sometimes the neighbors can throw things over by accident. The Director stated that anything that does not belong on the playground is immediately removed. LPA inquired about a tall tree that was observed with several limbs that hover over the toddler playground, and the Director advised LPA that the limbs were going to be cut and the branches were going to be trimmed back so that they do not hang over the playground area. Per the Director, the tree trimming project will be conducted on Friday, March 25, 2022. However, interviews revealed that until this project is completed, any limbs or debris that falls onto the playground area will be immediately removed and/or thrown away. Therefore, based on the information obtained and LPA’s observations, the allegation is UNSUBSTANTIATED.
Based on the lack of witnesses and conflicting statements obtained during confidential interviews, there is no evidence to prove or disprove that a child sustained head injury, administrator did not report an unusual incident to a daycare child's representative, staff denied daycare children more food when they said they were still hungry, and facility is in disrepair.
Although the allegations may have happened or is valid, there is not a preponderance of evidence to prove that the alleged violations did or did not occur, therefore the allegations are UNSUBSTANTIATED.
