32 | Director did not ensure the personal rights of persons in care to safe and healthful accommodations, in that children did not consistently wear face coverings while in the facility, as required by the CA Department of Public Health Guidance on face coverings. Director disclosed that there was some confusion as to what guidance was referred to, as far as children wearing masks. The Director was receiving mixed reactions from parents, in regards to themselves and their children being required to wear masks. Therefore, at this time, there is not a preponderance of evidence to prove there is consistent mask wearing in the facility.
Based on observation, interviews conducted and conflicting information, the allegation is UNSUBSTANTIATED. A finding that the allegation is unsubstantiated means that although the allegation may have happened or is valid, there is not a preponderance of evidence to prove that the allegation occurred.
An exit interview was conducted with Director, Appeal Rights were discussed and issued, a copy of this report was provided, and a Notice of Site visit was issued.
The Notice of Site Visit (LIC 9213) shall be posted where the parent/guardian of children enter and exit the facility. The Notice of Site Visit (LIC 9213) must remain posted for 30 days during the hours of operation after each site visit by a licensing representative. Failure to maintain posting as required will result in a civil penalty of $100.00.
A copy of this report must be made available for the next three years. |
