On 11/25/2019 at 9:22 AM, Licensing Program Analyst (LPA) Susan Brewer, arrived at the facility for the purpose of concluding an investigation regarding a complaint received concerning the above allegations. LPAs S.Brewer was given access to the facility by the Director-Lilah Wheeler. LPA toured the facility pre-school classrooms and took a census of 25 children. LPA met with Lilah Wheeler, to further discuss the conclusion of the complaint/allegations. On 11/22/19, an inspection was previously conducted regarding the complaint and on that visit facility documents were obtained.

On 11/04/2019 it was alleged that a staff yelled at a daycare child.

LPA conducted Confidential interviews with staff on November 22, 2019 and November 25, 2019, indicate the following: One staff stated in their confidential interview, that the individual staff witnessed a director spoke "harshly" to a day-care child on 11/04/2019, however, the child was not yelled at. During a confidential interview conducted with another staff member, it was stated that the staff member did not witness any incidents of yelling on 11/04/2019, nor has that individual staff witnessed yelling on any other occasion.

11/25/2019 LPA S.Brewer, observed meeting minutes from the Early Childhood Development Board (ECD). The board meeting minutes document the incident on 11/04/2019, a staff yelled at a child who was sitting on the floor in front of her.

Based on the LPAs observations and interviews, that were conducted, staff witnessed the director speaking "harshly", but not "yell" and added that this was more of a stern voice.

Although the allegation regarding personal rights, in which staff are speaking inappropriately to children, may have happened or is valid, there is not a preponderance of evidence to prove the alleged violation did or did not occur, therefore the allegation is unsubstantiated.

An exit interview was conducted, and a copy of this report was issued to the Director Lilah Wheeler.

A Notice of Site Visit was issued.

A copy of this report must be made available to the public, upon their request, for the period of 3 years.

LPA conducted confidential interview with a staff which indicated the following: A staff confirmed to witness the allegation of a director grabbing a day-care child inappropriately by their left arm, causing the child to cry and complain about their arm hurting.

11/25/2019 LPA S.Brewer, observed meeting minutes from the Early Childhood Development Board (ECD). The board meeting minutes document the incident on 11/04/2019, describing how a director grabbed a child who was sitting on the floor in front of her. The description documented the director grabbing a day-care child and forcibly, lifting the child up off of the ground, causing the child to yell out loud "ouch!", then immediately started to cry and continued to complain that their arm hurt. It was also acknowledged that the board has knowledge of the continued inappropriate and aggressive disciplinary actions, by the same staff.

Based on the LPAs observations and confidential interviews that were conducted, and a review of additional pertinent information obtained, the preponderance of evidence standard has been met, therefore the above allegation is found to be Substantiated. California Code of Regulations, Title 22, Division 12, Chapter 1, is being cited on the attached LIC 9099D.

An exit interview was conducted, and a copy of this report was provided to Lilah Wheeler on 11/25/2019. Also provided was a copy of appeal rights (LIC9058) and their signature on this form acknowledges receipt of these rights.

A Notice of Site Visit was issued on 11/25/2019.

The licensee director Lilah Wheeler, aggrees to review polices and procedures of discipline with staff at the facility and conduct a professional development refresher course with staff on appropriate forms of discipline and alternate tools to re-direct day-care children when disciplining.

Based on LPAs observations, documention gathered and confidential interviews, a staff used inappropriate physical force by grabbingt the child's arm, as a form of discipline for a day-care child, causing the child to hurt and cry, which poses an immediate risk to the Health and Safety of the children in care.

Once the written professional develpment plan and proof of participation in training is completed., the licensee director will submit the plan to the Riverside Child Care Regional Office by 12/09/2019.
