32 | It was reported, on an unknown date, a child was given a bath while in care and a child was “hit”. It was alleged, a staff member touched the child’s private part, stated they smelled bad and proceeded to give them a bath. It was also alleged the child was hit with a hand on the head and buttocks. During the course of the investigation, staff denied the allegations stating children are not touched inappropriately and do not bath while in care. Licensee indicated that there was a time when a child was assisted with cleaning themselves after going “poop”, but due to their age, Licensee advised the child’s parent they should “teach the child how to properly clean themselves”. Licensee and staff also deny “hitting” any children. Interviews revealed staff will talk to the children and tell them to listen and/or place them on “timeout”. While conducting children interviews it was disclosed, children do not bath at the day care and are not “hit” by anyone at the day care. Due to the age range of subject child(ren), interview(s) with child(ren) did not reveal information that could be used to corroborate or negate the allegation.
Based on information obtained during this investigation, through interviews conducted, the review of pertinent documentation, and after receiving conflicting information, the allegation is UNSUBSTANTIATED. A finding that the allegation is unsubstantiated means that although the allegation may have happened or is valid, there is not a preponderance of evidence to prove that the allegation occurred.
An exit interview was conducted with the Licensee, Appeal Rights were discussed and issued, a copy of this report was provided, and a Notice of Site visit was issued.
The Notice of Site Visit (LIC 9213) shall be posted where the parent/guardian of children enter and exit the facility. The Notice of Site Visit (LIC 9213) must remain posted for 30 days during the hours of operation after each site visit by a licensing representative. Failure to maintain posting as required will result in a civil penalty of $100.00.
A copy of this report must be made available for the next three years.
