On date and time listed, Licensing Program Analysts (LPAs) Aman Sharma and Justin Giese arrived at the facility to conduct a required annual inspection. LPAs toured the facility, inside and out. Records were reviewed, and the following was observed and/or discussed:
Normal days and hours of operation are: Monday- Friday 7:00am-5:30pm

OFF-LIMIT AREAS INCLUDE: Garage, Laundry Room, Room 2, Master Bedroom and bathroom, and Casita.

· The facility is operating within the licensed capacity and appropriate ratios


· Appropriate supervision was provided during this inspection

· A working telephone is present and current number is on file

· Appropriate fire extinguisher, smoke detector and carbon monoxide detector were present and in working order during this inspection.

· Fireplace is not accessible by children.

· All hazardous items were not made inaccessible to children-SEE LIC809D

· Not all toxins were locked in an off-limit area during the inspection- SEE LIC809D

· Weapons are not present at this time. Licensee understands all guns, weapons and ammunition must be key locked separately and made inaccessible per Title 22 Regulations

· Verification of control of property is on file

· Facility Sketch, Emergency Disaster Plan & Notification of Parent’s Rights poster are posted

· Mandated Reporter Training for licensee and spouse was completed on 04/2022 and expires on 04/07/2024

· Pediatric CPR and First Aid Card for licensee and spouse expire on 01/15/2024

· Health & Safety Certificate is completed and on file.

· No bodies of water at this time. Licensee understands all bodies of water including ponds, above ground pools & spas, in-ground pools & spas, and some fountains must be properly covered or fenced per Title 22 Regulations. The Department must be notified before and after installation of the above types of bodies of water. In addition, all wading pools or similar product must be emptied immediately after use and stored in an upright position.

· Clean, safe and age appropriate toys were available for children to use.

· Current roster is on file

· Documentation of fire and disaster drills are also on file – Last drill conducted on: 10/21/2022

· The Licensee was informed of their reporting requirements and is provided with the Regional Office’s Unusual Incident Reporting email mailbox: UnusualIncidentReportsDO09@dss.ca.gov

· Children’s records were completed, licensee’s file and spouse’s file are not complete- SEELIC809D

· Resident and/or staff records reviewed indicate that all adults who require caregiver background checks have received all required clearances or exemptions.

· The Licensee can submit transfer forms to associate new individuals or to disassociate someone from your facility at: Associations_Disassociations862@dss.ca.gov

- LPAs discussed the safe sleep regulations with licensee and discussed the Child Care Licensing Safe Sleep webpage as an additional resource at: https://www.cdss.ca.gov/inforesources/child-care-licensing/public-information-and-resources/safe-sleep LPAs also informed licensee of the importance of checking for recalled infant devices on the United States Consumer Product Safety Commission (CPSC) website at https://www.cpsc.gov/ and recommended they register all infant devices with the CPSC to be notified of any recalls on their purchased equipment.

-Incidental Medical Services (IMS) policy was discussed. For IMS information see Evaluator Manual - Regulation Interpretations and Procedures for Family Child Care Homes Section 102417. When any IMS is provided, a Plan for Providing IMS must be submitted to the Department.

- Licensee was reminded that all adults 18 and over living or working in the home, including employees and volunteers, must obtain a criminal record clearance or exemption, or transfer their existing clearance or exemption, prior to initial presence in a licensed Family Child Care Home. A civil penalty of $100.00minimum/day up to $500.00 maximum per day/per person will be assessed if this regulation is violated.

The Licensee, Mirtha Garcia confirmed that there are no Registered Sex Offenders living in the facility and/or using the facility address for their mailing address.

A NOTICE OF SITE VISIT WAS ISSUED AND IS TO BE POSTED IN A PROMINENT LOCATION AT THE FACILITY FOR THE NEXT 30 DAYS ALONG WITH A COPY OF ALL TYPE A DEFICIENCIES (LIC9099D/809D) CITED DURING THIS INSPECTION. A COPY OF ALL TYPE A DEFICIENCIES CITED DURING THIS INSPECTION MUST ALSO BE IMMEDIATELY (WITHIN 24 HOURS OF THE CHILD’S NEXT DAY IN CARE) GIVEN TO THE PARENTS OF ALL CHILDREN ENROLLED IN THE CHILD CARE FACILITY AND ANY CHILDREN ENROLLED INTO THE CHILD CARE FACILITY OVER THE NEXT 12 MONTHS (AT THE TIME OF ENROLLMENT). A copy of this report was provided to the licensee on this date and must be made available to the public upon request for the next 3 years.

Based on observation, the licensee did not comply with the section cited above in 5 out of 5 items. The following was found in the on-limit kitchen area of the facility: Prescription medications were found in one of the cabinets without a lock on it. Knives were found in a seperate cabinet, also without locks. In the on-limit restroom, there were loofah's and shampoos/conditioner in the bathtub. All of these items were accessible to the children in care, which poses an immediate health, safety or personal rights risk to persons in care.

Based on observation, the licensee did not comply with the section cited above. It was observed, that two infants (under the age of 2) were placed in the crib with blankets. One child also had a bottle in the crib, with blankets hanging from each side of the crib. This is a violation of Safe Sleep Regulations and poses an immediate health, safety or personal rights risk to persons in care.
