32 | S1 admitted to calling child “slow” due to the child taking too long to complete tasks. It was also revealed that parent was not notified about C1 having issues in the classroom or that the child was having a hard time keeping up with the other children. Additional interviews with Parents indicated that the lack of communication when the children are being picked up or dropped off with S1 was bothersome to parents. According to interviews with parents conducted, children would be picked up at the door with no communication on the child’s day. On occasion, the door was open by S1 and as parents were approaching the door was closed before the parent reached the child.
Based on interviews conducted and documentation gathered, the allegations that staff member is physically abusive to children in care is Substantiated. The preponderance of evidence standard has been met and the facility is cited for violation of Title 22, Division 12, Chapter 1, Section 101223: Personal Rights. S1 violated the personal rights of children when tapping child on head to get their attention and hitting child(ren) on hand with a book.
This report cites a Type A violation and shall be provided to parents/guardians of children currently enrolled and to parents/guardians of children newly enrolled at the facility during the next 12 months. Parents/guardians must sign Form LIC9224 to be kept in each child's file. In addition, a copy of the Complaint Investigation Report (LIC9099) shall be posted next to the door and must remain posted for 30 consecutive days. LPA Zeron provided the Director, Delrine Tilleratne with section 1596.8595 instructions from the Health and Safety code related to Type A violations. LPA Zeron also provided a printout of LIC9224.
Exit interview was conducted with the Director, Delrine Tilleratne. Notice of Site Visit was posted during the inspection. The Director was informed that the notice of site visit must be posted for 30 consecutive days. Failure to post will result in civil penalties of $100. Appeal Rights and deficiency was discussed. The Director, Delrine Tilleratne was provided a copy of their appeal rights (LIC 9058) and their signature on this form acknowledges receipt of these rights. All appeals must be in writing and received by the Regional Office within 15 business days. |
