On 03/15/2022 at 2:58 PM, Licensing Program Analyst (LPA) Ana Noble conducted an unannounced inspection to deliver the findings on the above stated complaint allegations. LPA Noble met with Licensee Beatriz Cota, conducted COVID assessment prior to entry into the home. LPA discussed the purpose of today’s inspection and interview Licensee, Mrs. Cota and children.

Investigation consisted of an initial inspection on 2/23/2022, interviews with Licensee, relevant parties and observation conducted of children in care. On 2/23/2022, LPAs Ana Noble and Jeanette Sanchez observed Child #1 and Child #2, in high chairs for most of the time LPAs were present on this date from 9:48 AM until 10:50 am. These children were not removed from the high chairs until children started fussying/crying. Additionally, interviews were conducted with relevant parties revealed that children particularly infants and younger toddlers, have been observed in the high chairs for long periods of time. It was described as children being observed in the high chairs or swings all day long. The evidence collected shows a child in a swing that LPAs observed at the facility, with a child's head cover, while sleeping. See LIC9099-C for continuation of this report.

Based on LPA’s observations, interviews and evidence collected the preponderance of evidence has been met and the allegation of Personal Rights-Licensee covered infants face with a blanket and Children are left in a high chair for an extended period of time while in care is substantiated. The facility is being cited with Title 22, violation of Personal Rights, which poses an immediate risk to children in care.

An exit interview is conducted, copy of report, LIC9099D and appeal rights were provided to Beatriz Cota. The report was reviewed and discussed, with Mrs. Cota.

The facility representative was informed that the “Notice of Site Visit” must be posted for 30 consecutive days. Failure to post will result in Civil Penalties of $100.00. The “Notice of Site Visit” must be posted on or adjacent to the door. Failure to post Type A reports for 30 days will result in a Civil Penalty of $100.00.

If the facility receives a Type A violations, the licensee shall post and provide copies of the report to parents/guardians of the children in care at the facility by the next business day, and shall provide to the parents/guardians of children newly enrolled at the facility during the next 12 months. In addition, the licensee shall immediately post upon receipt the Proof of Correction for 30 consecutive days and provide a copy to current and enrolling parents. The licensee is to keep Acknowledgement Receipt (LIC 9224) signed by parents in each child’s file.

Licensee agrees to immediately cease the use of blanket over children faces during nap time. In addition, Licensee agrees to submit a written plan on how she will ensure the safety of children in care to met this regulation. Submit proof to the Department by 3/16/2022.

This requirements was not met by evidence by pictures provided showed a child while at the facility with a blanket over child's face in addition to interviews conducted revealing that children in care are often seen with blanket over there faces. This is an immediate risk to the health and safety of children in care.
