Due to required lead testing requirements, Licensing Program Analyst (LPA), Susan Brewer conducted a Case Management inspection based on lead testing results received on the facility. LPA S. Brewer, toured the facility, took census and met with Licensee Director/Principal Colette Burgess, to further discuss lead results received and measures taken for remediation of lead exceedances. The Banning Unified School District (BUSD) conducted water testing for the school site, which resulted in a lead exceedance in Building 671A/Room 6, water outlet E.

It was determined that the BUSD submitted an inaccurate report on behalf of the 334844229-FLORIDA STREET DISCOVERY CENTER, regarding the water outlet identified as E in Room 6 that tested a lead exceedance, which is not part of the licensed preschool or used by preschool children. A waiver is on file for Classroom 8, however the Classroom 8 is not currently being utilized at this time and is not attached to the building that was reported to have a lead exceedances. Photos also obtained of additional source for access to water. The facility has access to additional water resources using water pitchers and disposable cups for indoor and outdoor use at building 671C, Rooms C2, C3, C4 and Building Room 8.

However, during today's inspection, the licensee was unable to provide proof of lead testing conducted for the 334844229-FLORIDA STREET DISCOVERY CENTER. LPA conducted a record review, which revealed that the facility did not meet compliance with this standard as described in the written directives outlined in PIN 21-21-CCP. It was determined that the agency failed to have the 334844229-FLORIDA STREET DISCOVERY CENTER building 671C, designated Preschool Classrooms, C2, C3 and C4 water sources tested for safe lead levels of 5.5 ppb or below.

Additionally, the following resources were discussed and provided from PIN 21-21-CCP dated July 28, 2021 and PIN 21-21.1-CCP December 28, 2022.

101700.6 Grant Funding for Qualifying Child care Centers

(a) Senate Bill 862, Chapter 449, Statutes of 2018 allocated $5 Million to the State Water Resources Control Board for testing and remediation of lead in the drinking water of Child Care Centers based on the following criteria:

(1) Those that serve children zero to five years of age, with the highest priority for Child Care Centers that provide care for children zero to three years of age.

(2) Those that have 50 percent or more of their registered children who receive subsidized care.

(3) Those that operate only one facility.

(b) To determine a Child Care Center’s eligibility for possible funding the Department will provide access to a link to an online eligibility form located on the Department’s website and on Sacramento State’s Office of Water Programs website.

(1) A Child Care Center interested in financial assistance shall complete the eligibility form, which shall include instructions for completing and returning it, prior to receiving any grant funding for which it may qualify. To determine a Child Care Center’s eligibility for possible funding, the provider will need to complete an online eligibility form available at Office of Water Programs’ website

Due to the agency not taking action to test for the preschool program as required in the Health and Safety Code Section 1597.16(a)(1), where all licensed Child Care Centers (CCCs) constructed before January 1, 2010 to test their drinking water for lead contamination between January 1, 2020 and January 1, 2023, deficiency has been cited. See LIC809D.



An exit interview was conducted, and appeal rights discussed. LPA S. Brewer provided Licensee Director Colette Burgess, with a copy of this report, appeal rights and notice of site visit. This report must be made available to the public upon request for three years.
