32 | At this time, none of the children/staff interviewed expressed any concern regarding the odor in the facility. LPAs were able to smell the odor consistent with staffs statement of sewage/drains.
LPAs observed all staff wearing masks, however none of the children were wearing masks nor have they ever been required to wear one. Interviews revealed a recent change in facility management may have created a lapse of understanding of the CDPH/CCLD partnership and COVID-19 Guidance. A technical assistance visit was conducted on 7/6/21 in which the most recent COVID-19 guidance was provided to and reviewed with Director and Licensee.
LPAs observed staff and children outdoors during the outdoor activity time scheduled in the morning. All classrooms are currently using the playground simultaneously due to current weather conditions (summer heat). On 7/15/21 at approximately 8:25am, LPAs observed staff not adequately supervising all children on the playground. At 8:30am LPAs observed staff did not have visual observation of 4 children in various play areas. LPAs observed two children playing on the swings while all other children (approximately 19) and 2 Staff were on the other side of the playground, at least 25-30 ft away. Another pair of children ran to play under shading towards the back of the playground. At no time during LPAs observation were staff appropriately positioned to monitor the entire playground.
During physical plant inspection, LPA observed what were identified as “Stepping-Stones” on the playground. These stones are embedded in the dirt on the left side of the playground near the small play structure; however, the stones are a tripping hazard as the dirt around the stones are no longer level to the surface. Interviews revealed children have previously fell on the unleveled ground. According to the director, there is a plan in place to restructure/resurface the area; however, there are no current means to prevent children tripping.
Based on LPA’s observations and interviews which were conducted, the preponderance of evidence standard has been met, therefore the above allegations are found to be SUBSTANTIATED.
