32 | It was also disclosed the child is never left in the “corral” without a staff member present. Staff stated the “corral” was never used as a form of punishment. The child was unable to be interviewed due to age and is no longer enrolled. Furthermore, the facility does have documentation of the dangerous behaviors and has had discussions with the Authorized Representative which supports their decision to use the “corral” during transition periods.
This agency has investigated the complaint regarding the above allegation. Based on the interviews conducted with pertinent parties the Department is unable to determine whether the child was isolated. The Department could not interview the child, video was not available, the Department could not determine the length of time or how many times the child was placed in the “corral”, and the Department received conflicting statements on the reasoning why the “corral” was being use, therefore, the allegations are UNSUBSTANTIATED. A finding of unsubstantiated means, although the allegations may have happened, or are valid, there is not a preponderance of the evidence to prove the allegations occurred.
