32 | Regarding the allegations that C1 sustained unexplained bruising in care, interviews revealed bruises were observed on C1’s arm and back, however it was unclear what the bruises were from. One interview revealed the bruise(s) on C1’s arm appeared to be from fingerprints, while another interview revealed there was only one bruise seen on C1’s arm. Interviews revealed S1 had not been seen to grab or pick up C1 by the arm and there was no documentation of an incident where C1 would have been bruised on the arm. Regarding bruises on C1’s back/spine, one interview revealed S1 had not been seen to handle C1 or any other child in a rough manner, while another interview revealed S1 has been seen to be rough when sitting children in chairs and when laying C1 and other children down on the changing table and napping mats. Regarding the scratch to C1’s face and shoulder area, interviews with staff revealed staff did not recall seeing a scratch on C1’s face nor did any staff recall C1 being scratched by any children. Another interview revealed scratches were observed on C1’s shoulder area that looked like nail marks, however it was unknown how C1 obtained the scratches. Interviews also revealed at times, C1 would come into the CCC with scratches on C1’s body and staff were told the scratches were from C1’s cat or from C1 playing. S1 denied handling C1 or any other children in a rough manner that would cause bruising or scratches.
Regarding the allegation that staff are not supervising children at all times. Interviews revealed that C1 was bit on two different occasions by two different children. Interviews further revealed that the first time C1 was bit by a child, both S2 and S3 were present and observed the incident. Interviews also revealed that the second time C1 was bit by another child, S3 was present and observed the incident. Interviews revealed that the bites happened very quickly and the two children that bit C1 had not had any other biting incidents prior.
Based on confidential interviews conducted during the investigation, C1 did sustain unexplained bruising and scratches, however, due to conflicting statements, it could not be determined how or when the injuries occurred or if the CCC was in violation of Title 22 Regulations, therefore those allegations are unsubstantiated. Based on confidential interviews conducted during the investigation, the allegation that staff are not supervising children at all times may have occurred, however is not supported, or proven by evidence. Therefore, that allegation is unsubstantiated. An exit interview was conducted and a copy of this report and appeal rights were discussed and provided to Director Anna Garcia. A notice of site visit was also provided and must remain posted for 30 days. |
