Personal Rights: Staff failed to ensure child was wearing shoes while playing outside

LPA Goodell met with director Gina Queral to deliver findings regarding the allegation listed above. Today’s inspection, LPA conducted a census of 14 children, 5 staff and director. During the investigation LPA Goodell toured the facility both indoor and outdoor, conducted observations, and obtained documents related to the complaint allegation. Interviews with director and infant staff were also conducted. It was alleged that staff failed to ensure child was wearing shoes while playing outside. LPA learned through staff, interviews that children wear shoes prior to going outside. In addition, staff stated children will often take shoes off and staff will put shoes back on. During inspections LPA observed children wearing shoes outside. Although the allegation may have happened or is valid, there is not a preponderance of the evidence to prove that the alleged violation occurred, due to conflicting information obtained during the investigation. As a result, the above allegation is UNSUBSTANTIATED.

No Title 22 Deficiencies cited. LPA reviewed report with the director and provided copies. Appeal Rights also issued and discussed. Notice of Site Visit posted and must remain posted for 30 days.
