 | Licensing Program Analyst (LPA) Marea Behvand contacted Leonel Gutierrez (Director) to deliver complaint findings pertaining the two allegations listed above. The census at the time of the tele-investigation was: 5 children and 2 staff in the LadyBug's classroom, 6 children and 2 staff in the Butterfly's classroom, and 3 children and 2 staff in the Bumble Bee's classroom. In the matter concerning the allegation that facility staff withheld food from day care child as a form of discipline, the finding for the allegation is deemed UNSUBSTANTIATED. It was alleged by RP that on February 12, 2021, Facility Staff #1 did not give day care child (Child #1) the cookie he decorated during the Friendship Day party because he was not listening and threw the cookie away in the trash in the presence of the child. According to interviews conducted and documentation reviewed, LPA learned that on February 12, 2021 while Facility Staff #1 was passing out the cookies to the children for afternoon snack, Child #1 was climbing on classroom tables and throwing things when Facility Staff asked Child #1 to sit down for snack.  Child #1 yelled that he didn't have to listen to Facility Staff #1 and ran out of the room. Facility Staff #1 stated that the cookie was not thrown away. Facility Staff #1 stated that the cookie was placed at the front reception desk for Child #1 to take home. Facility Staff stated the cookie was ultimately back in the possession of Child #1 when Parent #1 arrived during pick up time. Although the allegation may be valid or happened, there is not a preponderance of evidence to prove or disprove. In the matter concerning the allegation that the facility retaliated against the Reporting Party for filing a prior complaint, the finding for the allegation is also deemed UNSUBSTANTIATED. It was alleged by RP that due to RPs prior complaint against the facility, that the facility is retaliating against RP by throwing Child #1s cookie away on February 12, 2021 and by receiving a voicemail on March 2, 2021 from Child #2s teacher, Facility Staff #2, saying that Child #2 is not welcome at the facility. According to interviews conducted and documentation reviewed, LPA learned that Child #1s cookie was not thrown away and that Child #2 was sent home only for the day for kicking, throwing chairs, and shoving another day care child unprovoked. Facility Staff #2 stated that the voicemessage left for Parent #2 was that Child #2 was not welcomed to stay for the remainder of the day, but that Child #2 could return tomorrow. Although the allegation may be valid or happened, there is not a preponderance of evidence to prove or disprove An exit interview was conducted and a Notice of Site Visit was posted.
