**THIS IS AN AMENDED REPORT**
On November 1, 2022, at approximately 8:30 AM, Licensing Program Analysts (LPAs) Alize Tillery and Matt Gallo, arrived to the facility to further investigate and conclude the complaint investigation, for the allegations listed above. Upon arrival, LPAs were at the main entrance, waiting to be let in for approximately 3 minutes. LPAs were let in by Director and Staff #1, who were arriving to the facility themselves.

Upon entrance, Director guided LPAs through the facility tour; LPAs observed Staff #2, who is an Aide with no units, supervising 7 children in the Purple Room, which is licensed for the Preschool component. LPAs asked Director for the ages of the children in the classroom, Director responded that they had to combine the yellow classroom and purple classroom, since 2 staff members called out today. In the purple classroom, Director stated there were 3 preschool children and 4 toddler children. LPAs learned from Director that the toddler children were under 24 months, aging one child at 18 months and the other three children at 22 months. Staff #2 does not have the qualifications to supervise children alone. LPAs will Substantiated allegation, Unqualified Staff.

It was also alleged that the day care is operating out of ratio. Because Staff #2, an Aide, was observed supervising 7 children alone without a teacher present, the facility is operating out of ratio. LPAs will Substantiate allegation, Day care is out of ratio.

It was also alleged that, a day care child with dairy allergy was provided dairy crackers. Interviews with staff members, revealed that Child #1 came into contact with a restricted food item, resulting in Child #1 having a breakout to the face, near the mouth area. Staff members stated that they believe Child #1 grabbed a snack from a friends plate, while staff were not looking. LPAs will Substantiate allegation, Day care child with dairy allergy was provided dairy crackers.

Exit interview conducted and report was reviewed with the Director, Maribelle Wong.

Title 22 deficiencies are cited on LIC 809-D. Director acknowledges, that for TYPE A DEFICIENCIES ONLY upon receipt, Director shall post LIC 809-D with Type A deficiency for 30 days and provide copies of this licensing report to parents/guardians of children in care at the facility and to parents/guardians of children newly enrolled at the facility during the next 12 months. LIC9224 must be signed by parents/guardians and kept with the children's forms as a receipt whenever any Type A documents are provided by the Director. LIC9224, Appeal Rights and a Notice of Site Visit was provided to Director.

On November 1, 2022, at approximately 8:30 AM, Licensing Program Analysts (LPAs) Alize Tillery and Matt Gallo, arrived to the facility to further investigate and conclude the complaint investigation, for the allegations listed above. Upon arrival, LPAs observed 10 infant children, supervised by 3 staff.

One allegation is that the day care does not have proper ventilation. LPA is aware that the building that the facility is in is undergoing reconstruction and staff do not have access to control the main heating or air conditioning system. As of Spring 2022, the facility has been using swamp coolers throught the facility to maintain a comfortable temperature in the rooms. Director stated that maintenance visits the facility daily to ensure that a comfortable temperature is kept and maintenance will adjust the swamp cooler if need be. During LPA visit on 9/1/2022, 10/7/2022 and today, LPA did not observe the temperature of the rooms to be uncomfortable. Based on LPA and LPM observations, and information received during staff interviews, the allegation, day care doesnt have proper ventrilation, is unsubstantiated.

The second allegation is that "Drinking water filters have mold in them". During LPA visit on 9/1/2022, 10/7/2022 and today, LPA did not observe any mold in the water filters/britas. During staff interviews, LPA learned that staff switch the filters monthly and clean the britas daily. Based on observations and information received during staff interviews, the allegation, Drinking water filters have mold in them, is unsubstantiated.

Based on the investigation conducted, although the allegations may have happened or are valid, there is not a preponderance of evidence to prove that the alleged violations occurred. As a result, the allegations are Unsubstantiated.

LPA reviewed and provided the report and appeal rights to Director. LPA also provided a notice of site visit and Director acknowledges it is to remain posted for 30 days.
