Licensing Program Analyst (LPA) Kelly Ferrara met with Assistant Director Maria Harland in order to deliver findings for the above allegation. LPA observed that there are currently four school age children in care with one staff. During the investigation, LPA interviewed the Assistant Director, three staff, and reviewed relevant documentation provided by the facility.
It was alleged that the school age classroom is operating out of ratio. Consistent statements were made during interviews that the school age classroom was over ratio on more than one occasion during the month of July. Interviews revealed that the solution to being over ratio was to have multiple school age children sit in the hallway or the office with the Director in order to remain in ratio. During review of the classroom count sheets, LPA observed the school age classroom to be over ratio on the following dates: 7/8/21, 7/9/21, 7/19/21, 7/20/21. Teacher-Child Ratio for a school age classroom is 1 teacher per 14 children.
Based on the evidence obtained, LPA determined the allegations are substantiated, meaning that the preponderance of evidence standard has been met. Citation has been issued on the following page. Appeal rights were provided and exit interview was conducted. Notice of site was posted and must remain for 30 days.

Assistant Director understands that for TYPE A DEFICIENCIES ONLY upon receipt, Assistant Director shall post LIC 9099-D with Type A deficiency for 30 days and provide copies of this licensing report to parents/guardians of children in care at the facility and to parents/guardians of children newly enrolled at the facility during the next 12 months. LIC 9224 must be signed by parents/guardians within 24 hours and kept with the children's files as a receipt.

A teacher shall supervise no more than 14 children or with an aide a maximum of 28 children. This requirement was not met as evidenced by: Interviews and documentation revealed the school age classroom was over ratio on more than one occasion. This is an immediate health and safety risk to children in care.

Assistant Director stated that remaining in ratio is not currently an issue. They have hired more teachers and stopped enrolling children in school age. Assistant Director shall submit a complete staff schedule with staff assigned to the classroom, staff who will provide breaks/lunches, and bus runs. POC will be emailed to LPA by due date.
