On May 13, 2022 at 8:40 AM, Licensing Program Analysts (LPAs) Amanda Sutter and Alize Tillery met with Director Shanel Tate for the purpose of an unannounced annual inspection. Upon arrival, LPAs observed five infants in the “Baby” room supervised by two staff and seven toddlers in the toddler room supervised by three staff. Facility hours of operation are Monday through Friday from 5:45 AM to 5:30 PM. Annual fees are not current.

LPAs toured all activity and classroom spaces (infant classrooms 1 and 2, and toddler classrooms 4), the kitchen area, the napping areas, and the outdoor play area. LPA observed the following documents are posted: License, Emergency Disaster Plan, Personal Rights, Parents' Rights Poster, menus, and daily schedule. Cleaning disinfectants and hazardous items are appropriately stored and inaccessible to children. There are no bodies of water, poisons, or firearms on the premises. Furniture and equipment are in good condition and the floors appeared to be clean throughout the facility. Director was reminded that sheets on cots and mattresses need to be changed daily. While touring infant classroom two, LPAs observed a cockroach in a refrigerator. No children were present in the classroom. Toileting facilities are in safe and sanitary. Two out of three toilets observed were in operating condition. LPAs observed four changing tables in arms reach of a sink. LPAs reminded director to ensure that bottles and food are labeled with both name and date and stored in the refrigerator. Food preparation space is free of litter, all food was protected against contamination, and storage containers with solid waste have covers. The program provides breakfast, lunch, and snack.

Drinking water is readily available to children both indoors and outdoors. LPAs observed children’s personal cups. LPAs observed the electric sign in and sign out sheet. Program uses a tablet and app called ProCare, which also used to communicate with parents. Playground equipment and surfaces are free of loose or sharp parts. There is rubber cushion beneath the playground equipment in the outdoor play area. There are sufficient equipment and toys. Shaded areas are supplied by the building.

Five staff files and seven children files were reviewed. Infant files did not contain an Individual Infant Sleeping Plan (LIC 9227). LPAs did not observe a 15 minute sleep log. Staff files were not observed to be complete. At least one staff member present today has current Pediatric CPR and First Aid certification which expires in 10/2023. All staff currently employed with the facility have a criminal record clearance and are associated to the roster. Director stated that the last fire drill was conducted 11/2022. Director was reminded that fire drills need to occur at least every six months and be recorded. LPAs observed a functioning smoke detector and 2A10BC fire extinguisher. Director stated that she did not know where the carbon monoxide detector was located.

LPAS discussed the safe sleep regulations with licensee and discussed the Child Care Licensing Safe Sleep webpage at https://www.cdss.ca.gov/inforesources/child-care-licensing/public-information-and-resources/safe-sleep as an additional resource. LPAS also informed licensee of the importance of checking for recalled infant devices on the United States Consumer Product Safety Commission (CPSC) website at https://www.cpsc.gov/ and recommended they register all infant devices with the CPSC to be notified of any recalls on their purchased equipment.

Incidental Medical Service (IMS) policy was discussed. For IMS information see Evaluator Manual - Regulation Interpretations and Procedures for Child Care Centers Sections 101173 and 101226. When any IMS is provided, an updated Plan of Operation that includes IMS must be submitted to the Department. The following information regarding ADA was provided: US Department of Justice (USDOJ) toll-free ADA Information Line at (800) 514-0301 (voice)/ (800) 514-0383 (TTY) and link to publication: Commonly Asked Questions about Child Care Centers and the ADA available at: http://www.ada.gov/childqanda.htm

Facility representative was reminded that all adults 18 and over, including employees and volunteers, must obtain a criminal record clearance or exemption, or transfer their existing clearance or exemption, prior to initial presence in a Child Care Center. A civil penalty of $100.00 minimum/day up to $500.00 maximum per day/per person will be assessed if this regulation is violated.
