Licensing Program Analysts (LPAs) Soleil Marx and Jennifer Velasco, met with Facility Representative, April Macklin, to close a complaint investigation alleging that staff did not prevent a day-care child from biting other children in care. Throughout the investigation, LPAs inspected the facility, reviewed relevant documentation, observed interactions between staff and children in care, and conducted staff and parent interviews.

LPAs observed injury reports which showed injuries had reasonable explaination for occurance. Interviews with parents did not reveal concerns of children being injured outside of normal childhood incidents. Parent's stated that they are notified promptly by the Director if injuries occur and receive a written injury report at pick up.

LPAs observed staff being attentive to children in care, intervening when needed, and spread out amongst the activity spaces to maintain supervision.

Interviews with staff revealed that staff spread out in activity spaces, redirect challenging behavior, and shadow children when needed to minimize injuries. Staff stated parents are notified immediately by phone when injured and a written injury report is provided to authorized representatives at pick up.

LPAs did not gather any pertinent information that could prove that a staff did not prevent a day-care child from biting other children in care. Although the allegations may have happened or is valid, there is not a preponderance of evidence to prove the alleged violation did or did not occur, therefore the allegation is UNSUBSTANTIATED.

Exit interview conducted, report reviewed with Facility Representative, appeal rights provided. Notice of Site was issued and must remain posted for 30 days.
